【禁聞】425十二週年 揭“搞政治”之謎

【新唐人2011年4月23日訊】1999年的4.25號,中國法輪功學員到國務院上訪局申訴,開啟了公民依法維護自身權利的序幕。12年來,在中共的迫害中,經常以4.25法輪功萬人上訪,宣稱“法輪功搞政治”。那麼,大陸的法律是否真正維護公民的上訪權利?法輪功學員當年上訪是為了甚麼?甚麼才是“搞政治”呢?請看詳細報導。

99年4.25號,從清晨開始,就有從全國各地趕到北京國務院上訪局申訴的法輪功學員。

因為天津警察剛剛抓捕了45名法輪功學員,他們是去天津教育學院雜誌社說明事情的。因為這家雜誌社曾刊登了一篇不符合法輪功真實情況的文章,這些學員用自己的煉功體會闡明事實,卻遭到逮捕。得知消息的各地法輪功學員於是不約而同的想去北京反映這個情況,讓警方放人。

最早去上訪的學員,自動排隊等候在西安門大街的國務院上訪局門外。早上6點多,警察指揮排隊的法輪功學員向南走,到中南海外的府右街後停下。隨著越來越多的法輪功學員加入,在長安街、西四、西單、北海有大約萬名來上訪的法輪功學員排隊靜候。

從當時的媒體錄影、大量照片和目擊者回饋來看,法輪功學員沒有標語、口號和任何激烈的行為。中共利用喉舌媒體污蔑法輪功學員是圍攻中南海,並衍生出“法輪功搞政治”的說法。

法輪功發言人張而平表示,法輪功學員按照“真善忍”修煉自己的身心,對任何社會都是有益的,他們沒有犯罪。而99年法輪功學員採用上訪的方式,是要求當局釋放被抓的學員。

張而平:“一方面就是說,他們按中國現行的這個法律去申訴自己的這個權利,另外一方面他們無非是想做好人,而且遵循中國這種傳統價值觀念。那法輪功學員在維護這一理念,實際上不是維護人類賴以生存的價值觀念嗎?”

1999年中共公開迫害法輪功之前,中共安全部門在全國範圍內不斷派人到法輪功的煉功點上刺探情報、拍照,甚至用噪音、噴水槍等手段,騷擾煉功的學員。1996年黨報《光明日報》曾公開詆譭過法輪功,隨後媒體上陸續出現抹黑法輪功的文章。

美國中國問題專家章天亮博士分析說,西方社會的媒體自由、司法獨立、全民選舉制,在大陸一黨獨裁的體制中全都行不通,法輪功學員並不是要求在政府架構內獲得權力和地位,而是以請願的方式維護憲法賦予公民的基本權利。

章天亮:“實際上就是一種請願行為,當時因為天津已經抓了人,法輪功學員因為沒有辦法去糾正,既沒有選票,也沒有獨立的司法,同時也沒有媒體為他們發聲,所以他們唯一剩下的一條出路就是當時去請願。”

在美國從業多年的資深律師葉寧發現,大陸的憲法中雖然寫有公民的“宗教信仰自由”、“結社自由”等條款,但在總綱、第一條和其他條款中卻又設了多重限制。他說,實際上,法律迫使中國人只能有“信仰中共”的自由。葉寧指出,中共的法律和行為違反了國際公約。

葉寧:“它(中共)也是根本違反了聯合國《世界人權宣言》,和聯合國《公民權利和政治權利國際公約》這兩個重大的文件,中華人民共和國自己也是假惺惺的參加的。”

12年來,中共不斷在媒體上污蔑法輪功“搞政治”。美國南卡萊羅納大學的教授謝田博士認為,中共故意把黨文化中把“搞政治”的概念扭曲,然後又以此來迫害法輪功。他說,“搞政治”是非常正當的事情。

謝田:“任何公民想要從事政治的話,實際上是他們的權利,是完全正當的。我覺得“搞政治”這個詞被中共的媒體宣傳得好像是大逆不道、犯上作亂,簡直是世界上最大的意見醜聞和罪行。只允許它(中共)做,不允許老百姓做,那不就是‘只許州官放火,不許百姓點燈’嗎?”

12年來,中國大陸的法輪功學員中,已確認被迫害致死的有3432人,涉及各省、各行業和各個社會階層,其中女性人數超過一半。

On April 25, 1999, Falun Gong practitioners petitioned
at Dept for Letters and Visits of State Council, raising
the curtain of Chinese upholding rights with law.
Since then the CCP always claimed Falun Gong
participating in politics with the petitions by 10,000
practitioners on April 25. Do laws really uphold
petition rights of Chinese? What did they petition for?
What is involving in politics?

In order to petition at Dept of Letters and Visits in
Beijing, from early morning of April 25, 1999, Falun
Gong practitioners went there from all over China.

Because Tianjin police just arrested 45 Falun Gong
practitioners clarifying truth to Tianjin Institute of
Education magazine, which had published an article
smearing Falun Gong. These practitioners tried to
clarify the truth with their own experience, but were
arrested. Other practitioners who heard the news
spontaneously planned to go to Beijing to clarify
this situation for the release of fellow practitioners.

The earliest arrivals queued outside of
Dept of Letters and Visits of State Council
on Xi’anmen St. At 6 am, police directed practitioners
south to Fuyou St outside of Zhongnanhai.
As more and more joined, practitioners were filled
the roadside of Chang’an Ave, Xisi, Xidan, Beihai,
about 10,000 practitioners waiting quietly in line.

According to videos, photos and witnesses,
Falun Gong practitioners did not have posters,
slogans or any drastic actions. It was the CCP which
manipulated official media to smear Falun Gong
as ‘sieging Zhongnanhai’ and ‘involving in politics’.

“On one hand, practitioners utilized the right of
petition by law; on the other hand, they just want to
be good people and follow a traditional Chinese
value.

Isn’t this also upholding the value relied on by all?”

Before the persecution in 1999, the CCP’s security
sector sent spies continuously to practice sites of
Falun Gong to gather formation, photos, and even
harass them with noise, spray guns and other means.
In 1996, the Party newspaper Guangming Daily
defamed Falun Gong openly, and smearing articles
in other medias followed.

Expert Dr. Zhang Tianliang analyzed in Western world,
people have media freedom, judicial independence,
and national election system, but none will work in
the one-party dictatorship in China. Falun Gong
practitioners were not after power or positions in
the government, but upholding their basic rights of
petition defined in the Constitution.

It was actually a petition. Tianjin police arrested some
practitioners, but there was no way to rebut, since
there were neither votes, nor independent judiciary,
nor media support. The only way out was to petition
in Beijing.

Ye Ning, a senior US lawyer found although China’s
Constitution includes articles on ‘religious freedom’
and ‘association freedom’, multiple restrictions were
set in the general statement, the first article and
other terms. Ye said the law forced people to only
have ‘freedom of faith in the CCP’. Ye pointed out
the CCP’s law and behavior violated international
conventions.

It (CCP) is also a fundamental breach of the UN’s
Universal Declaration of Human Rights and Civil and
Political Rights. The PRC was hypocritical at their
participation in these two important documents.

In the past 12 years, the CCP had been continuously
slandering Falun Gong ‘to involve in politics’.
Dr. Xie Tian in University of South Carolina said the
CCP deliberately twisted the concept of ‘politics’ in
the persecution of Falun Gong. He said, ‘politics’ is
actually a very legitimate thing.

It is a citizen’s right to involve in politics and is fully
justified. ‘To involve in politics’ was propagandizing
by the CCP media to be outrageous, guilt rebellion,
and the biggest scandals and crimes in the world.
Only the CCP is allowed to involve in politics, but not
people. Isn’t it “Allow officers to set fire, but not
allowing people to light lamps"?

3,432 Falun Gong practitioners, more than half to
be women, have confirmed deaths in persecution,
distributing in all provinces, industries and sectors of
society in China.
