【新唐人2013年10月10日訊】年屆八旬的北京訪民王秀英，狀告財政部拒絕公開對朝鮮援助的有關資訊。北京一中院受理訴狀並且決定10月8號開庭。8號當天，王秀英突破警方重重阻攔，趕到法院之後，卻被告知庭審已經取消。興奮趕來旁聽的媒體也撲了個空。
現年82歲的王秀英，去年12月向財政部提出資訊公開申請，要求財政部公開中國在2011年和2012年援助朝鮮的資訊。但是，財政部以涉及國家機密為理由，拒絕公開有關信息。今年5月，王秀英將財政部告上法庭，法院同意受理此案，並決定在10月8號下午兩點開庭。
9月29號，王秀英的女兒王鳳仙接到一個電話，告訴她「法院不會開庭了」。王鳳仙要求對方履行法律正式程式，但沒有結果。8號中午12點，王秀英和女兒準備前往法庭時，受到來自北京市白紙坊派出所警察的阻攔。
北京訪民王秀英女兒王鳳仙：「昨天上午早上起來，我這兒就有警車堵門，然後12點20分的時候我們出去，要去法院，警察就不讓去。最後連分局的人都來了。僵持了一個小時，我們把事發出去了，有用推特給推出去了。就說警察阻止，不讓老太太去法庭。結果1點1刻的時候，他們警察撤了，我們就打著車去了法院。到那兒兩點。」
但是，當他們按時到達法庭的時候，法庭書記員僅以口頭通知「不開庭了」，至於甚麼時候開庭，則另行通知。許多手握旁聽證趕來的媒體記者，都撲了個空。
王鳳仙：「他當時還給好多人開了旁聽證的證明，結果這個書記員，今天反應過來說，我們失誤了。我們要判我們就不給你開這個旁聽證了。」
那麼，在此之前，北京一中院為甚麼同意開庭？王鳳仙和其他人都覺得：或許這是法院的一個失誤？
而王秀英之前為甚麼想要要求財政部公開對朝鮮的援助資訊呢？
王鳳仙：「坦率說，我們就是一訪民。我們現在了解底層的老百姓生活的特別苦。竟然在這種情況下，我們去援助它（朝鮮），它製造原子彈核武器，既然用我們的錢，老百姓就有權利知道這個錢在做甚麼。」
北京維權人士李學惠代理這個案件，他向《新唐人》解釋，狀告財政部，並不追求結果，而是追求過程。是想讓中共自己表現他們的醜陋。
北京維權人士李學惠：「中國是一個甚麼樣的國家？社會狀況是甚麼樣？通過這一個事實來反映出來。我認為最好的結果是我們敗訴，其次的結果是不開庭，第三個結果是我們勝訴。如果說，我們敗訴，那證明的的確確，特別實實在在的表現：司法是不公正的。但是現在選擇不開庭，也是表明這個不是真正的司法。」
王秀英和李學惠還向國家保密局提出政府資訊公開申請，要求公開中共援助朝鮮的項目，包括物資和資金的數額﹔要求保密局告知，這些是否是國家機密？保密等級是多少？保密期限是多久？但保密局至今沒有任何回音。
李學惠：「然後我們向國家統計局表示，政府訊息公開，要求公布中國貧困人口的標準是甚麼？貧困人口有多少？我們有這麼多的貧困人口，還要拿出錢來援助朝鮮，朝鮮去試驗核武器，發射導彈，威脅亞洲乃至世界的和平。」
李學惠說，他跟王秀英都是訪民， 他們是社會最底層的人，受到許多司法不公正的待遇，沒有人關注他們。
據王鳳仙介紹，2001年他們家遭遇強拆，王秀英去向政府告狀，但政府不給解決。王秀英再去天安門和中南海打橫幅，當局還是不給解決。
2008年北京舉行奧運會，王秀英申請遊行，引起外媒關注。警方把當時77歲高齡的王秀英勞教一年。當時她已經有一只眼睛看不見，另外一只眼睛的視力也只有0.01。

Elderly Woman Sues Finance Ministry, Court Cancels Hearing
Ms. Wang Xiuying, a Beijing petitioner in her 80’s, has sued
the Ministry of Finance for refusing to disclose information
about aid given to North Korea.
The Beijing Intermediate People’s Court accepted the case
and decided to hold a hearing on October 8.
On Oct. 8th, after Ms. Wang got by all of the police,
she arrived in court, but was told the trial was cancelled
The excited members of the media allowed to
sit in on the hearing were speechless.
In Dec. 2012, 82-year-old Ms. Wang Xiuying requested the
Ministry of Finance to publicize information.
She requested information about the supplements that China
sent to North Korea between 2011 and 2012.
She was told such information is a state secret.
In May, Ms. Wang sued the Ministry of Finance
and the court accepted the case.
The hearing was scheduled for 2:00 pm on Oct. 8.
On Sept. 29, Ms. Wang’s daughter Wang Fengxian received
a phone call telling her that the Court won’t hear the case.
Wang Fengxian asked that they carry out the legal procedures,
but replied in vain.
At noon on Oct. 8, Wang Xiuying and her daughter were
blocked by police officers from the Beijing Baizhifang
police station when they prepared to go to court.
Wang Fengxian: “esterday morning, there was a police car
blocking people when I got up.
We left at 12:20pm, but were stopped by police on the way
to court, and they had more officers arrive.
We were deadlocked for an hour until someone posted to their
Twitter that the police wouldn’t let an old lady go to court.
At around 1:15pm, the policemen withdrew and we drove to
court, and arrived at 2pm."
When they arrived at court on time, the court clerk only stated
orally that court would not be in session until further notice.
Many media reporters permitted to sit in were left dumbstruck.
Wang Fengxian: “The clerk who issued a lot of people permits
to sit in said this was a mistake, saying: We don’t give permits
if we know ahead of time that it’s cancelled."
So, before this, why did Beijing court accept the case?
Wang Fengxian and others agreed that this might be
a mistake from the court.
Why does Ms. Wang Xiuying want the Ministry of Finance to
publish this information on aid to North Korea?
Wang Fengxian: “Frankly speaking, we are just petitioners.
We knew that lower class citizens have a hard life.
Under such a circumstance, we still supported North Korea.
However, they used our support to produce nuclear weapons.
The Chinese regime gave away our money,
we have the right to know how our money has been used."
Beijing activist Li Xuehui is helping with Ms. Wang’s case.
He told NTD that the result of Ms. Wang’s lawsuit
isn’t important, but the procedure is.
They want to see how badly the CCP reacts.
Beijing activist Li Xuehui:
“What kind of country is China?
What is the state of society now?
It will be reflected from this case.
I think the best result is that we lose the case,
the second best result is that the hearing isn’t held,
the third is that we win the case.
If we lose the case, it proves that the judiciary is unjust.
Now they chose to cancel the trial,
which also proved that they are not a true judiciary."
Ms. Wang Xiuying and Li Xuehui have also requested that
the National Administration for the Protection of State Secrets
publicize information on aid given to North Korea,
including the amount of goods and funds sent.
They asked, do these issues belong to state secrets?
What is the degree of secrecy?
How long will these secrets be kept for?
They have yet to receive any response.
Li Xuehui:"Then we asked the National Bureau of Statistics
to release the information.
We asked them what the standard of poverty is.
How much of China’s population lives in poverty?
China has so many people living in poverty,
but the regime sends funds to support North Korea,
and yet North Korea uses these funds to do nuclear tests,
firing missiles, threatening Asian and world peace."
Li Xuehui says that he and Ms. Wang Xiuying are petitioners,
the lowest class citizens who face many judicial injustices,
and no one pays attention to them.
Wang Fengxian says that their home was
forcibly demolished in 2001,
her mother complained to the government,
but they didn’t want to deal with it.
Ms. Wang later went to Tiananmen and Zhongnanhai,
unfolding banners to protest,
but authorities still haven’t dealt with her mistreatment.
During the 2008 Beijing Olympic Games, Ms. Wang Xiuying
applied for permission to hold a parade to draw public attention.
However, police sentenced the 77-year-old Ms. Wang
to one year in jail.
At that time, Ms. Wang was blind in one eye,
and her other eye’s visual acuity is only 0.01.
