【禁聞】電郵解密 夏業良被解僱原因曝光

【新唐人2014年01月15日訊】大陸自由派學者,原北京大學經濟學院副教授夏業良,被北大校方以「教學評估成績差」的理由解聘。最近,夏業良和北大某黨委書記來往的電子郵件曝光,人們發現,北大解僱夏業良的真實原因,與他公開支持「公盟」創始人許志永的「新公民運動」有關。

現年40歲的許志永,是中國知名的法律、憲政學者,他多年來致力於公民維權活動,曾發起「公盟」組織,也是「新公民運動」的主要創始人。去年12月,許志永被中共當局正式起訴,罪名是「涉嫌聚眾擾亂公共場所秩序」。

據了解,北京大學經濟學院黨委書記章政,寫給原北大經濟學院副教授夏業良的一封電郵明確表示,北大反對夏業良參加聲援許志永的聯合簽名活動,要求夏業良儘快取消簽名,並作出書面說明,卻遭到夏業良反駁和拒絕。兩個半月後,北大以夏業良「教學評估成績連續倒數第一」為由,將他解聘。

夏業良指出,北大對他的「積怨」由來已久,而他對「新公民運動」的支持,無疑成了北大將他解僱的最終導火索。

原北京大學經濟學院副教授夏業良:「從過去十年來,我的很多批評黨和政府的做法,然後09年五月份寫給劉雲山的那封公開信, 以後又聯名支持了很多起國內的維權抗爭行動。也包括對許志永這個事件,他要求官員公布財產,然後被抓,我覺得這是公民履行合法的權利,卻受到這樣的對待,是十分不公平的,那我肯定是要支持的。」

去年8月8號,章政發給夏業良的郵件中說:一個黨員教師,不應該參加要求官員公開財產的聯合簽名。章政還表示,許志永被抓是公安部門的所謂依法處理。而作為一名黨員必須服從黨的紀律等。

夏業良:「校方覺得我這樣做法都是不符合它們的要求,所以在郵件裡對我提出了要求,甚至認為我這樣做是不對的,那我就進行反駁。」

夏業良在回章政的電子郵件中說:關於許志永博士因主張官員公開個人財產而被拘留事件,我們的認識顯然與官方有較大差異,許志永是北大畢業的法學博士,在法律專業層面顯然比你我更具有專業資格與發言權。

夏業良:「我就覺得作為一個公民,他有權利表達自己維護憲法的做法。讓官員公布財產,接受公眾的監督,尤其是媒體的監督,那才是真正的反腐。不是說由共產黨內部搞甚麼雙規啊,解決一部分官員的腐敗問題啊,但是絕大多數官員腐敗還是沒有得到遏制,而且對於自己的同夥、同一群體、同一陣營的人,他們就不去打擊,所以這個反腐是有選擇性的。」

夏業良在回信中還強調:「所謂『北大常為先』,就是因為1949年以前的北大,校方能夠兼容並蓄各種思想異見,不會因言獲罪,不會因為思想與黨中央不能保持一致,就受到各種打壓乃至被監聽、 跟蹤、軟禁、監禁。北大是全民寄予厚望並納稅提供經費支持的國立大學,不應淪落為黨校,更不應淪為一黨專制和意識形態控制的工具。」

夏業良還寫道:「倘若北大校方執意要根據上級指令,對他予以除名或解聘,或不再續聘(無論採用何種名義),這將是北大校史上一件極不光彩的公眾事件。」

夏業良:「我的目地和動機,就是讓中國成為一個憲政民主的法治國家,讓每一個公民都擁有自己的自由,包括表達、言論、出版、結社的自由。包括財產權利方面的自由。我覺得我這樣做是無愧於一個北大人的稱號,作為中國自由主義知識份子,那我就在一定的歷史時點上站出來,為自己國家民族的未來說一些良心話,推動社會一丁點進步,我當然覺得自己做的是非常值得的。」

雖然夏業良為了堅守自己的理念,而失去了北大教授工作,但是他表示,如果能夠重新選擇,他依然會做出同樣的決定。

Uncovered – the Real Reason for Professor Xia’s Dismissal

China’s liberal scholar and former Associate Professor at
Peking University (PKU) School of Economics Xia Yeliang,

was dismissed by PKU purportedly for
“poor teaching evaluation scores."

Recently uncovered emails between Xia Yeliang and a
Chinese Communist Party (CCP) Secretary of
Beijing University reveal that:

the real reason for Xia’s dismissal is related to
his public support for the “New Citizens Movement"
promoted by NGO “Open Constitution Initiative" founder Xu Zhiyong.

Forty-year-old Xu Zhiyong is a well-known
legal and constitutional scholar in China.
For years now he has been committed to civic initiatives.
He launched the “Open Constitution Initiative" organization, known as Gongmeng, is also
one of the key founders of the “New Citizens Movement."

In December 2013,Xu Zhiyong was formally indicted
by the authorities allegedly for “gathering and disturbance to
public order."

CCP Party Secretary Zhang Zheng of the School of Economics
at PKU wrote an email to PKU School of Economics Associate
Professor Xia Yeliang warning:
PKU opposes Xia Yeliang participation in
the joint signature activity to support Xu Zhiyong
and demands that Xia Yeliang cancel his signature ASAP
and make a written confession on the cancellation.

The request was rejected by Xia.

Two and a half months later, PKU dismissed
Xia Yeliang, on the pretext of:
“Persistently Ranked in the Lowest Position of
Teaching Evaluation Scores, for a number of years."

Xia Yeliang pointed out that PKU had
“grievances" with him for a long time.

His support for the “New Citizen Movement" was undoubtedly
the fuse for him being dismissed.

Xia Yeliang: “In the past decade, I sent many criticisms
to the party and government, such as
my open letter to Liu Yunshan in May 2009,
support for a lot of domestic human rights protests, etc.
Xu Zhiyong was arrested for asking officials to
publish their property.
I think this is the right of a citizen.
It is very unfair, I certainly want to support citizen rights."

On August 8, 2013, Zhang Zheng sent Xia Yeliang an email
saying that a teacher who is a CCP member should not request
public officials to publish their property.
Zhang Zheng also said Xu Zhiyong’s arrest was based on
so-called legal procedures by the Public Security Departments.
As a CCP member, one must obey the party’s discipline.

Xia Yeliang: “The School thinks what I did is not
in line with their requirements.
They even told me what I did was wrong.
Then I refuted."

Xia Yeliang stated in his email to Zhang Zheng that:
“Our perspectives over Dr. Xu Zhiyong’s detainment
for asking officials to publish their personal property
has somewhat large differences.
Xu Zhiyong received his Ph.D in Laws at PKU.
Clearly he is more qualified to speak in this respect than us."

Xia Yeliang: “A citizen has the right to express their wish
for the upholding of the Constitution.
Asking officials to declare their property
for the public and media to supervise is real anti-corruption.
CCP’s internally disciplines and anti-corruption only hit a few.
The majority of corrupt officials are not curbed,
as the CCP does not attack their own factions.
So the CCP’s anti-corruption is selective."

Xia Yeliang replied in this email: “the so-called
‘PKU is always ahead’ because the school was inclusive
of various strands of thought before 1949.
People were not punished for speech,
nor monitored, followed, house arrested or detained
for ideology that is different from the Party.
PKU is a national prestigious university
supported by people’s taxes.
It should not be a CCP Party school,
nor should it become a tool for
one-party dictatorship and ideological control."

Xia Yeliang also wrote: “If PKU insists on
dismissing him according to the command from above,
it would be a disgraceful event in the history of PKU."

Xia Yeliang: “My motivation is to promote China to become
a country of Constitutional Democracy,
that every citizen has his own freedom,
including freedom of expression, speech,
press, association and property rights.
I think that is worthy of the title of a PKU Member.
As a liberal intellectual in China,
I step out at a certain point in time, in history to say
something out of conscience for the future of our nation,
to promote social progress a little bit.
Of course, I feel what I did is very worthwhile."

Although Xia Yeliang lost his job at PKU
for sticking to his belief, he expressed that he would
make the same decision again, given the opportunity.
