【禁聞】王功權認罪?王瑛:不等於認錯

【新唐人2013年12月07日訊】據香港《南華早報》報導,中國風險投資家兼人權活動家王功權,在獄中已經承認了北京警方對他「擾亂公共秩序罪」的指控,並且,他的一份認罪視頻可能將在《央視》上播放。王功權的好友告訴本臺記者,「認罪不等於認錯」。而讓一個正在刑事偵查程序當中的嫌疑人,上《央視》認罪,恰好讓人看清到底是誰在犯罪。

香港《南華早報》12月5號報導說,已被羈押近3個月的知名企業家,「新公民運動」發起人之一的王功權,承認了北京警方對他的指控。《南華早報》記者還看到一份視頻, 神情憔悴的王功權現身,表示將和另一在押的「新公民運動」推動者——法學學者許志永,斷絕關係並劃清界限。

王功權還表示,「自願解除」對辯護律師陳有西的委託。

知情人士透露,這個「認罪」視頻可能在《央視》播放,以證明他願意與中共當局合作,以獲得減輕懲罰。《南華早報》援引一個消息來源,懷疑王功權在看守所期間受到虐待。

北京中恆聚信投資基金管理有限公司董事長王瑛,和王功權一起投身公民運動。她對《新唐人》表示,王功權認罪的事情,現在並沒有充份的證據,只是傳言。她披露,上星期她跟王功權太太曹女士通電話的時候,聽說王功權的狀態還比較正常。當時他已經受到86次審訊。

王瑛表示,即使王功權認罪也不奇怪。因為認罪和認錯,不是一回事。

王瑛:「我覺得認罪和認錯,這個差距很大的。因為中國的這些憲法,包括各種法律的規定,可能一個認罪的人會說,我認罪,因為你法律是這樣規定的。這是有可能的。可是我不認為是我錯。」

王瑛透露,王功權早就想到參與公民運動可能遭到獨裁政權的牢獄之災。他對同道們半真半假的說過,如果誰被抓、認罪甚至是彼此揭發,大家都要給予諒解。

王瑛:「以王功權這個人的性格和他的理念,在這種傷害(別人)、和自己是否保持個人氣節之間去做選擇,王功權一定是選擇保護他人,而不會去為了強調要保持自己的個人氣節和形象去傷害其他人。」

最近一段時間以來,名人上《央視》認罪似乎成為一種「慣例」。美籍華人、微博名人薛蠻子,廣州《新快報》記者陳永洲,都穿著囚衣在屏幕上懺悔。就連房地產大亨潘石屹,也被強迫在《央視》鏡頭前,結結巴巴的表態,支持政府打壓謠言的決定。

北京政論學者陳子明認為,《央視》逼人認罪是「文化大革命」的再現。

陳子明:「這個事情我覺得是在恢覆文化大革命的一系列侮辱人格的做法,比如戴高帽,彎腰,遊街,這是一種現代的遊街,戴高帽,開批鬥會。完全是違背人權準則的。而且也沒有甚麼作用。只能是暴露了他們這些做這種事的人的嘴臉,法西斯嘴臉。」

王瑛認為,《央視》上的任何所謂「認罪」都不是真的。

王瑛:「它是剪接出來的人想說甚麼,而不是在那上面說話的人想說甚麼。因為他完全沒有任何可能把一個現場直播給電視。他有甚麼意義呀?他現在已經是批捕了的,在一個刑事訴訟程序當中的一個犯罪嫌疑人,還正在程序當中,卻在電視上播他有罪。這件事情本身不是在說明誰有罪嗎?是誰有罪啊?可能破壞法制的人有罪。他破壞一個國家法制的基礎,這個罪可大了去了。」

王功權和王瑛,都是成功的投資家、企業家,為甚麼他們會積極投入到公民運動當中?王瑛表示,中國社會能夠往前前進,企業家的人身權和財產權,必須獲得充分保證,那是不可或缺的一部分。

Investor and Activist’s Guilty Plea “Doesn’t Mean Confession”

Hong Kong-based South China Morning Post (SCMP) says
jailed Chinese joint venture investor and human rights activist
Wang Gongquan has admitted to “crimes of disturbing public
order” as alleged by Beijing police authorities.
Meanwhile, a video file of his statement may be played
on China Central TV (CCTV).
Mr. Wang ‘s close friend told NTD reporters that
“pleading guilty doesn’t amount to a confession.”
In addition, to force a suspect who is still undergoing
the criminal investigation procedure to plead guilty on CCTV
just allows people to discern who is actually committing crimes.

On Dec. 5th, SCMP reported that Wang Gongquan, a noted
entrepreneur and co-founder of the New Citizen movement,
has admitted to allegations from Beijing Police authorities
after being confined for almost three months.
An SCMP reporter also watched the video showing
a weary looking Wang Gongquan saying he will
sever his relationship with and draw a line between himself
and Xu Zhiyong, a fellow activist and jailed legal scholar.

Wang Gongquan also said he would “voluntarily dismiss”
the legal services of defense lawyer Chen Youxi.

Insiders say the video of his “guilty plea” will be probably
broadcast on CCTV so as to validate his willing to
cooperate with CCP authorities for a lighter punishment.

SCMP cites sources who say they suspect that
Wang Gongquan was abused during the custody center.

Wang Ying (no relation), former chairman of Beijing-based
Zhongheng Juxin Investment Fund Management Co.,
is undertaking the citizen movement with Wang Gongquan.

She told NTD there’s been no confirmation
of Wang Gongquan pleading guilty, and that those are rumors.
She says last week she called Mr. Wang ‘s wife Ms. Cao,
who said Mr. Wang ‘s status was normal.
By then, Mr. Wang had been interrogated 86 times.

Wang Ying says that even if Mr. Wang pleaded guilty,
it is not odd, because pleading guilty and
acknowledging wrongdoing are not the same.

Wang Ying: “I think there is a major gap between
pleading guilty and admitting the mistake because of
China’s constitution and all sorts of other legal regulations.

It might be in such a case that an arrested person may say
‘I plead the guilty because your legal regulations are this way,
but I still don’t think that I am wrong.’”

Wang Ying says Mr. Wang had long thought his involvement
in the citizen movement may land him in the totalitarian
regime’s jails.

He also joked half seriously with his fellow colleagues,
that if one among them were arrested,
pleads guilty or even blows the whistle on each other,
everyone should show understanding.

Wang Ying: “Based on Wang Gongquan ‘s personality
and his beliefs, if given the choice between hurting others and
keeping his own integrity, Wang would certainly
choose to protect others rather than hurt others to insist on his
own integrity and image”.

In the recent period, having celebrities plead guilty on CCTV
seems to have become a sort of “custom”.
Chinese-American Weibo celebrity Charles Xue and
Guangzhou-based New Express Daily reporter Chen Yongzhou
pleaded guilty on CCTV in prisoner uniforms.

Even property tycoon Pan Shiyi was forced to stammeringly
express his attitude way on CCTV to support the decision
of the government suppressing so-called rumors.

Beijing political scholar Chen Ziming says
CCTV’s forcing people to plead guilty
is a recurrence of Cultural Revolution.

Chen Zimin: “I feel this is a reinstatement of the series
of personal attacks seen during the Cultural Revolution,
when they had people put on dunce caps and bend at the waist,
parading them in the streets while criticizing them violently.
To plead guilty on CCTV is a modern version of parading
them in the streets, completely violating human rights norms.
But even so, it’s no use, and can only serve to expose
the real fascist face of those people doing this. ”

Wang Ying says none of the so-called
“pleading guilty” cases on CCTV are genuine.

Wang Ying: “This is produced by an editor, rather than
the word from that person. Because there is absolutely no way
for them broadcast that on live TV. What does it mean?

The person is already under arrest and a suspect in a
criminal investigation. He is being investigated.
Yet during this critical period they’re broadcasted as guilty.
Doesn ‘t this incident itself show who’s committed a crime?
Who’s committed the crime here?

Perhaps it’s the one who has destroyed the foundation
of an entire nation’s legal system.
This crime is too great.”

Wang Gongquan and Wang Ying are both successful investors
and entrepreneurs, why did they actively join
the Citizen Movement?

Wang Ying says entrepreneurs’ having their personal rights
and property rights fully guaranteed is indispensable
to having Chinese society develop forward.
