【新唐人2013年11月20日訊】中國律師團籲廢除法外變相勞教

11月19號,中國保障人權律師團的近90位律師,聯合發表關於勞教制度廢止相關問題的聲明,呼籲廢除一切法律之外的變相勞教方式。

聲明中說,中共從1957年開始實施的勞教制度,是特定時空環境下的非法治產物,在中國的多個特定歷史階段,不同程度的成為踐踏人權、破壞法治的工具。尤其是1999年以後,為打壓某一特定群體,勞教措施更加氾濫。

聲明表示,律師團對三中全會《決定》中,有關「完善對違法犯罪行為的懲治和矯正法律」,保持高度的警惕和擔憂。

律師團建議中共人大常委通過立法明文廢止勞教,並要求各地司法部門對勞教受害者依法提出的國家賠償等事項,依照法律規定辦理。

聲明特別呼籲當局全面取締和清理一直在法律之外運行的所謂法制教育基地、法制教育中心、法制學習班、訓誡所、各類「黑監獄」等變相勞教手段,並追究相關責任人違法犯罪的法律責任。

甘肅「鼠標少年」被退學又復學

11月19號,被甘肅天水市「育生中學」退學的「鼠標少年」楊輝,又被學校請回覆學。

楊輝的代理律師游飛翥11月19號午夜從新浪微博發出「深夜快報」說,「副校長夜訪少年楊,重返校園不翻牆! 明天(11月19日),楊同學可返回課堂。」

據《美國之音》報導,游飛翥表示,楊輝能重回課堂,主要是因為他的遭遇得到了眾多網友的關注。

16歲的中學生楊輝,因在網路發表被中共警方認為是謠言的博文,而被刑事拘留。後來在輿論壓力之下,當局釋放了他。11月18號楊輝就讀的學校以「上面壓力大」為理由,將他退學。代理律師游飛翥當天在微博發出呼籲,楊輝因而復學。

安徽千人圍堵縣政府抗議強拆打人

安徽阜陽市太和縣三個村莊的上千村民,11月18號圍堵縣政府,抗議當局暴力強拆打傷多人,一男戶主更被打成植物人。

《中國茉莉花革命》網站報導,太和縣政府出動大批警察驅逐抗議民眾,多人被抓捕。

報導說,太和縣新來的縣委書記,新官上任三把火,強拆了上百套民房,又強迫村民購買某開發商建造的房屋,導致民怨沸騰。

Chinese Lawyers: Repeal Extrajudicial Detention

Nov. 19, around 90 Chinese human rights lawyers jointly
issued an announcement on annulment of reeducation through
labor (RTL) and any other illegal reeducation in disguise.

The announcement states that the RTL, established in 1957
by the Chinese Communist Party (CCP), is an unconstitutional
product that has abused human rights and undermined the rule
of law at various levels and specific historical periods of China.
Since 1999, it has been further widely used to suppress
certain groups of people.

The lawyers stated their high degree of vigilance and concern
on the CCP Third Plenum decision for “laws to punish and
redress criminal acts."

The lawyers suggested the CCP Standing Committee of the
National People’s Congress pass legislation to expressly
overturn RTL, and called on the judiciary system to conduct
compensation for RTL victims according to legal regulations.

The announcement particularly calls on the authorities to ban
all reeducation institutes, such as the so-called legal education
base, legal education center, or legal education classes, training
and discipline center, the black jails, and so forth.
It also asks to hold those who violate the laws accountable.

The Gansu Student Returns to School

Nov. 19, Yang Hui, a student of Yusheng school in Gansu,
previously expelled from school, returned to class.

Yang Hui’s attorney You Feizhu posted on Sina Weibo:"Vice-
principal visited Yang at night. (Yang) can return to school but
not to do on-line surfing through fire-wall. Tomorrow (Nov. 19)
Yang can return to the class."

Voice of America reported that You Faizhu said that Yang
was able to return to school due to attention from web users.

The 16 -year-old high school student Yang Hui was under
criminal detention on charge of spreading rumors online.
Under the pressure, the police released him.

On Nov. 18, the school expelled him under pressure from the
high authorities.
Attorney You Faizhu called out for help on the Internet
that day and Yang was allowed to back to school.

Thousands of Anhui Villagers Protest t Violent Demolition

Thousands of villagers from three villages of Taihe county,
Anhui surrounded the county government building on Nov. 18
to protest against the violent demolitions which had resulted
in many wounded, and one person left in a coma.

The Chinese Jasmine Revolution reported on-line that Taihe
County government sent police forces to evict protesters.
Many people were arrested.

It is reported that new Taihe county party secretary was
anxious to conduct the demolitions.
Hundreds of houses were torn down.

The secretary then forced the villagers to purchase a
developer’s buildings which caused the public resentment.
