【禁聞】海伍德家人提賠 涉政變活摘恐難成

【新唐人2013年08月14日訊】中共前重慶市委書記薄熙來案開審前夕,被薄妻谷開來毒殺的英國商人海伍德的母親,要求當局為海伍德的家人提供實質幫助。海伍德的遺孀王露露也要求谷開來做出賠償。法律界人士分析認為,由於薄熙來和谷開來涉及江系人馬政變、以及活體摘取法輪功學員器官販賣等罪行,而海伍德案與之有千絲萬縷的聯繫,中共懼怕真相被曝光,因此海伍德家人很難得到賠償。

美國《華爾街日報》8月12號獨家報導了海伍德的母親週日發佈的聲明。聲明表示,海伍德被毒殺已過去一年半了,導致家庭失去經濟支柱,要求中共當局給予補償,並儘快對涉案人員,包括薄熙來在內的高官進行應有的審訊處分,以減輕海伍德被害後,對家人特別是對兩個幼子的傷痛。

海伍德的母親還認為,由於案件涉及一名中共中央政治局委員和一些高級警官,當局在系統性的掩蓋真相。儘管她一再小心翼翼的與中共當局接觸,但一直未獲得實質回應。

13號,英國《路透社》引述消息人士的話透露,海伍德的遺孀王露露也一直在要求谷開來向自己和兩個年幼的孩子進行賠償。谷開來的代理律師李小林說,海伍德的家人要求3000萬元到5000萬元人民幣的賠償。

北京律師莫少平指出,按照中國的法律,做為受害方的親屬,有權向犯罪份子提出經濟和精神損失的賠償。

北京律師莫少平:「因為你的犯罪行為,導致受害方的家裏經濟損失,包括直接經濟損失,還有其他精神損失都可以提出來,但是我說的賠償,一定是向犯罪人、犯罪份子向他索賠,因為他的犯罪行為,給受害人的家庭帶來了經濟和精神損失。」

去年2月,時任重慶市副市長的王立軍潛逃美領館,泄露了谷開來毒殺海伍德等醜聞。隨後,海外《大紀元》曝光了谷開來是薄熙來和前中央政法委書記周永康等江系政變圈的核心人物。薄熙來和谷開來還被指稱涉及活摘器官、非法在國際販賣屍體等罪惡,海伍德因幫助薄家向海外轉移資產,被捲入他們其中,因此被「滅口」。

《法國國際廣播電臺》曾引述消息報導,海伍德死後兩天,谷開來與王露露曾在重慶一咖啡館見面,由武警守門清場,據說裏面傳出谷開來的抽泣聲。這次會面後王露露接受了海伍德酒精中毒死亡的結論,並同意不經驗屍把丈夫的遺體火化。

那麼,為甚麼王露露又提出賠償要求呢?

中國資深法學專家趙遠明:「現在谷開來、王立軍都判刑了,薄熙來也已經要公審了,在這個時候,她提出賠償問題,有可能重慶方面當時可能底下給她達成了一筆交易,但是這筆交易是不是履約了?現在都說不清楚。現在她看到這幾個人都被判刑了,在政治上,在中國他們沒有勢力了,不可能給她起甚麼作用了,所以她現在提出來。」

中國資深法學專家趙遠明分析,海伍德家人能不能得到賠償很難說,因為在薄谷兩人的案子中,貪腐的數額被中共減輕很多,而且都是黑錢,應該會被收為國有。此外,趙遠明還認為,如果海伍德因為參與倒賣器官等被滅口,中共懼怕真相曝光,更不可能做出賠償。

趙遠明:「因為海伍德已經死了,從海伍德嘴裏甚麼也說不出去了,薄熙來案件中把三個大罪,中共主動給他隱瞞起來了,現在只剩貪污受賄,濫用職權了,真正政變篡黨奪權,鎮壓法輪功,進行活體摘除販賣,中共已經主動給隱瞞起來了。」

去年8月,谷開來被控故意殺人罪被判處死刑,緩期兩年執行。薄熙來案也很快將開庭審理。還有媒體報導指稱,周永康目前也被中共立案調查。

Heywood Family Requests Compensation

With the approaching trial of Bo Xilai, former Chongqing
Communist Party Secretary, Neil Haywood’s mother has
asked Chinese authorities for substantial compensation.

Heywood’s widow Wang Lulu has also asked
Gu Kailai, Bo Xilai’s wife, for compensation.
Legal professionals believe that Bo and Gu
are implicated in the Jiang Zemin faction.
They are also believed to have been involved in
live organ harvesting of Falun Gong practitioners.
Neil Haywood is alleged to have been
involved in organ trafficking and other crimes.
The Chinese Communist Party (CCP)
is fearful the truth will be exposed.
Therefore, the Heywood family will face
difficulty collecting any compensation.

On August 12, The Wall Street Journal had
exclusive coverage of Heywood mother’s
statement, which was released on Sunday.

The statement said that Heywood was poisoned 18
months ago, and was the sole breadwinner for his family.
Mrs Heywood asked Chinese authorities to
compensate the family as soon as possible.
This would reduce the family’s suffering,
especially that of the two young children.
In addition, she also asked for severe punishment
for those who were involved in her son’s murder.

Heywood’s mother also believes that her
son’s case implicates a Politburo member
as well as a number of senior police officers,

However, the authorities have
systematically covered up the truth.
Although she was very careful in dealing with the
CCP, she has not received a substantive response.

On August 13, “Reuters" quoted sources saying
Heywood’s widow Wang Lulu has also requested
Gu Kailai to compensate her and the children.

Li Xiaolin, Gu’s attorney, said that the Heywood
family asked for 30 Million to 50 Million Yuan.

Beijing lawyer Mo Shaoping highlights that according
to Chinese law, relatives of injured parties are
entitled to economic and emotional compensation.

Mo Shaoping: “If one’s criminal behavior results
in losses for the injured party, including direct
economic loss or emotional loss, they can ask
the perpetrators or criminals for compensation.

This can be for economic and emotional damages.”

In February 2012, Wang Lijun fled to the U.S. Consulate,
in Chengdu, exposing the murder of Neil Heywood.
Subsequently, the overseas “Epoch Times" exposed
the political coup attempt by Bo Xilai and Zhou Yongkang.
Bo Xilai and Gu Kailai are also been alleged
to have been involved in live organ harvesting.
Allegations also exist around illegal
organ and body trafficking internationally.
Heywood is alleged to have helped Bo and his wife
transfer financial assets abroad from these above crimes.
This is why he is thought to have
been silenced and murdered.

“Radio France Internationale" released
a report two days after Neil Heywood died.
Gu and Wang Lulu met at a coffee shop
where armed police had cleared the area first.
It was learned that sounds of
sobbing came from inside the shop.
Wang Lulu accepted that Heywood’s
death was caused by alcohol poisoning.
She then agreed to cremate
his body without examination.

Why is Wang Lulu now asking for compensation?

Zhao Yuanming, senior legal expert: “Now Gu Kailai and
Wang Lijun are all in jail. Bo is having a public trial soon.
Bringing up such a request, Wang Lulu
is hoping to reach a settlement privately.

She can do so now, for all the perpetrators are powerless
Politically, and they can no longer bring her any harm.”

Zhao Yuanming believes that it is hard to tell whether
the Heywood family can get any compensation.
This is because in both Gu and Bo’s cases,
their corruption charges were reduced.

Their assets should go to the state.

Neil Haywood is alleged for his involvement
in organ trafficking, so he was silenced for that.
The CCP is afraid of the truth being revealed, so
it is likely that no compensation will be given at all.

Zhao Yuanming: “Since Heywood is
dead, one cannot get anything from him.
Out of the three major crimes Bo had committed,
two of them have been covered up by the CCP.
Now Bo Xilai will only be on trial
for corruption and abuse of power.

The real crimes, that of the military coup attempt, the
persecution of Falun Gong, and live organ harvesting
from Falun Gong practitioners have remained hidden.

Last August, Gu Kailai was accused of manslaughter,
and received a two year suspended death sentence.

Bo’s trial is coming soon.

There are media reports that Zhou Yongkang is
also under a criminal investigation by the CCP.
