【禁聞】姜瑜雷語:「擋箭牌」成眾矢之的

【新唐人2011年3月21日訊】2月下旬以來,中共除了嚴密監控可能跟「茉莉花聚會」有關的人、事、地,更竭力控制媒體,有十多名外國記者遭到中共警察毆打和騷擾。外交部發言人姜瑜被問及採訪自由問題時,警告外國記者「不要拿法律當擋箭牌」,《南方週末》最近以評論文章《法律應當是所有人的擋箭牌》,不指名的回擊了姜瑜言論。

《南方週末》在3月17號發表陳有西律師的評論文章:《法律應當是所有人的擋箭牌》。文章指出,外交部發言人姜瑜的言論暗示,「中國的法律體系只是一個口號和裝飾品,可以選擇性適用。政府需要法律時,法律就是百姓必須遵守的強制性規範;政府覺得法律礙手礙腳時,則可以棄如敝履。即法律是單向的,只用來約束百姓的,而不是用來約束公權力的。」

其實在《南方週末》發表以上言論之前,姜瑜的話早已經「讓子彈飛」——成爲眾矢之的。

網文《我要對政府說,不要拿法律當擋箭牌》指出:「法律本來就是老百姓拿來當擋箭牌用的,其中包括得到中國簽證的外國人,一個國家的法律如果沒有起到這個作用,而是用來保護統治者的,只讓一部分人拿來當擋箭牌,那麼性質就徹底改變了。」

文章作者余曉平指出:「中國就是這樣一個社會,立法者同時又是執法者,執法者同時又是自我監督者……行為規範非常明顯地給政府作了擋箭牌,那麼老百姓就甚麼擋箭牌都沒有,甚麼憲法,甚麼權益,一切都是浮雲。」

另一篇文章《別拿法律當擋箭牌,政府要讓法律飛》作者解濱認爲,法律本來就是文明國家裏百信用來抵擋邪惡的擋箭牌,護身符。

他寫道:「連法律都不能拿來當擋箭牌,那甚麼才可以? 關係? 官爸爸? 李剛?怪不得如今上訪人流如潮,而法院門口卻空空如也。 怪不得每天都有多少民房被強拆,而房主卻無處伸冤。 怪不得屁民們多年來喝三鹿奶、吃地溝油、住豆腐渣房也無可奈何。 原來這法律說飛就飛得無影無蹤。」

《法律應當是所有人的擋箭牌》的作者陳有西指出,姜瑜的話表現出來的是中共官員迷信強權而蔑視規則的潛意識,難怪中共官員會說出「你是替黨說話,還是替老百姓說話」、「沒有強拆就沒有新中國」、「與政府作對就是惡」、「拆遷自焚就是暴力抗法」等雷人的話。

2月27日下午,在網絡號召的第二輪「茉莉花聚會」地點之一,北京王府井麥當勞快餐店外,現場部署的大批警察、便衣騷擾毆打了十多名外國記者,他們拍攝的照片、錄像和錄音資料,大都被警方刪除,有9家新聞機構的記者受到拘留。

在3月3號的例常記者會上,外國記者援引中共在奧運期間頒佈的國務院537號令,指出這條法令容許外國記者在西藏以外地區採訪,無需向地方外事部門申請。外國記者質問說:在王府井這樣的公共場所拍照和攝像,並沒有違反中國法律,要求中共外交部發言人姜瑜指出外國記者觸犯了哪一條法律,致使警方粗暴對待?姜瑜卻對記者發言:「不要拿法律當擋箭牌」。

“Do Not Use The Law As A Shield"

Since late February, the CPP has been monitoring
closely “Jasmine Rallies"-related people and places,
and has been trying its best to control the media.
A dozen of foreign journalists were beaten
by the CCP』s police.
When asked about press freedom, Jiang Yu,
Foreign Ministry Spokeswoman,
warned foreign journalists,
“Do not use the law as a shield."
Southern Weekend magazine』s commentary
counterattacked Jiang』s remarks.

On March 17, Southern Weekend published
a commentary by Attorney Chen Youxi:
“The Law should be Everyone’s Shield".
In the article, Chen said, Jiang’s remarks implied,
“China’s legal system is only slogans
and decorations. It can be selectively applied
by the government. The law is used
by the government to bind the people.
It is discarded if it gets in the government』s way.
It is used to constrain only people, not authorities.”

Before Southern Weekend』s commentary
was published, Jiang』s remarks
were already a target of public criticism.

A blog article titled,
“I Want to Say to the Government,
Do not Use the Law as a Shield" argues,
“The law was originally designed
to be used as a shield by the people,
including foreigners with Chinese visas.
If a nation』s law is only used to protect the rulers,
then its nature is completely changed."
Its author Yu Xiaoping said, “China is such a society.
The legislators are the law enforcement personnel
and they are also self-supervising…
The Code of Conduct is clearly a shield
for the government. The people have nothing,
no rights, and no interests.

In another article, the author Jie Bin wrote
that the law is a shield in civilized countries.
He wrote, “If the law cannot be used as a shield,
what else can? Relationships?
Having an official for a Dad? Li Gang?
No wonder there are so many petitioners,
but nobody is in the courts;
No wonder so many houses
are forcibly demolished, while their owners
have no place to seek redress.
No wonder people drink melamine-tainted milk,
use poisonous oil and live in shoddy houses.
It turns out the law disappears without a trace."

Chen Youxi pointed out that Jiang’s remarks show
how CCP officials subconsciously have
blind faith in power and disdain rules. No wonder
CCP officials would make statements like,
“Are you for the party, or for the people?",
“No demolitions – no new China",
“Opposing the government is evil",
and other absurd statements of the like.

On February 27, in the 2nd round
of “Jasmine Rallies", at one of the sites
in Beijing』s Wangfujing District, a large number
of police and plainclothed police harassed
and beaten a dozen foreign journalists,
and deleted their photos, videos and recorded data.
Journalists from nine news agencies were detained.

At a routine press conference, held on March 3,
foreign journalists citied an official document,
the State Council-issued Decree 537, which allows
foreign journalists to interview anywhere
outside of Tibet, without applying for local permits.
Foreign reporters asked Spokeswoman Jiang Yu
which law was violated by foreign journalists,
taking photos in public places like Wangfujing.
Jiang Yu said, “Do not use the law as a shield."
