【禁聞】習近平定叛逃新標準 整肅軍隊

【新唐人2013年03月29日訊】中國大陸的最高檢察院和解放軍總政治部,聯合制定了40條軍人犯罪的立案標準,其中軍人申請政治避難、發表叛國言論視同叛逃等條款,引人注目。請看報導。

有關《軍人違反職責罪案件立案標準的規定》,中共喉舌《新華網》以「軍人公開發表叛國言論將被立案」為標題。

在叛逃罪方面,《立案標準的規定》宣稱,因反對國家政權和社會主義出逃、攜帶軍事秘密出境不歸、申請政治避難、公開發表叛國言論、投靠境外反動機構或者組織、叛逃敵方等行為者,應當被立案調查。

這一「立案標準」從3月28號開始正式執行。

北京時政觀察人士華頗指出,這是習近平上臺後整肅軍隊的信號。他認為,中共目前缺乏像鄧小平那樣掌控部隊的政治強人,如果國內再次發生像「6.4」那樣的大事件,必須讓軍隊聽話,所以習近平要整肅軍隊。

北京時政觀察人士 華頗: 「現在軍隊有兩種聲音:一種就是極左,還有一些人捲入了薄案;還有一種就是軍隊國家化,武裝軍隊國家化的聲音。這個對中共執政者來說是非常非常危險、非常非常害怕的。因為中共的軍隊既對外也是對內的,他要保證軍隊在關鍵時刻拉得動。」

香港《開放》雜誌去年5月號曾經報導,根據王立軍交代和中共中央調查,「紅二代」劉源、張海洋等人與薄熙來結盟,圖謀薄熙來「十八大」入常,掌控政法機器後,時機成熟將廢黜習近平,取而代之。

去年「十八大」,中共軍委副主席、四總部正職大調整,之前的熱門人物張海洋、劉源完全無緣。外界認為,受薄案影響明顯。

還有,去年5月,62歲、身體健康的成都軍區副司令員阮志柏,在京突然死亡,外界也猜測:阮志柏可能是 「清查薄黨軍中人物」行動中,造成的非正常死亡。

另外,曾有傳言:解放軍上將、副總參謀長章沁生,因主張「軍隊國家化」遭到停職,雖然隨後有軍方高級將領聲稱此事純屬謠言,但美國《紐約時報》去年8月報導,章沁生在去年初的一個軍方領導宴會上醉酒失態,當著胡錦濤的面,章沁生對自己未能進身中央軍委表示不滿,大吵大鬧。

《多維新聞》網指出,中共高級將領失禮舉動,以及薄熙來事件的發生,令中央高層對軍隊將領的忠誠度大為緊張。新任最高領導人習近平的一連串動作,正是這次思想整頓的延續。

時政評論家伍凡指出,中共軍隊多年不打仗,目前買官、賣官非常普遍,軍隊的不穩致使中共內部更加不穩,所以習近平上臺要加強軍隊整頓。

美國中文網站《中國事務》總編輯伍凡: 「現在軍隊裡有相當一部分人是不滿意軍隊,其中包括要叛逃、逃跑,因為軍隊非常腐敗。叛逃的就是反抗共產黨的這批人在叛逃,如果裡邊混的很好,又能當官又能吃香的、喝辣的,那他不會跑。」

中共最高檢機關報《檢察日報》援引高檢負責人的話說,之所以做出這一規定,是「為了進一步完善軍事司法制度,拓寬和深化軍事鬥爭法律工作準備,增強官兵能打仗、打勝仗的使命感和責任感。」

香港《東方日報》指出,這或許是軍方為開戰作準備,所以戰前明令整肅軍紀。一些中國網民也懷疑這份《立案標準的規定》的出臺,是為了開戰作準備。

但伍凡認為,這與打仗沒有絕對關係,因為即使不打仗也要整頓軍隊。伍凡說,如果軍隊不打仗、軍人吃喝嫖賭不能控制,就變成了土匪,最後,就是別人造軍隊、國家的反了。

Xi’s New Standards for Purging the Army

Mainland China Supreme People’s Procuratorate and the
People’s Liberation Army General Political Department,
jointly developed 40 new standards
for convicting and sentencing military criminal cases,
They include applying for political asylum and posting
treason remarks, which will be regarded now as a defection.

The Chinese Communist Party’ (CCP) mouthpiece Xinhua
published the article, ‘Soldiers publishing treason remarks will be put on record.’

The latest CCP’ ‘Provisions of Crime Standards’ claim
that people will be put on record and investigated,
if they are against the state power and socialism,
carry military secrets and escape from the country,
apply for political asylum, publish treason remarks, seek
refuge in reactionary organizations, defect to the enemy, etc..

These ‘Provisions of Crime Standards’
are being formally implemented as of March 28.

Beijing current politics observer Hua Po pointed out,
this is a sign of Xi’s purge of the army after coming to power.
He believes that CCP lacks political strongmen
who can control the army like Deng Xiaoping;
if a big incident like June 4th happens again, the army must
be obedient, thus Xi wants to purge the army.

Hua Po: ’Now the army has two voices: this of the ultra-
leftists, some of whom are involved in Bo Xilai’s case;
and that of the nationalists
in the military and the army forces.
This is very dangerous and terrifying
for the CCP rulers.
Because the communist forces both foreign and domestic,
want to ensure the military is obedient in crucial moments.’

Hong Kong ‘Open’ magazine reported last May some
revelations of CCP’s investigation on Wang Lijun’s case.
It said, ‘second generation reds’ like Liu Yuan
and Zhang Haiyang allied with Bo Xilai,
to become members of CCP’s top standing committee
during the 18th CCP National Congress.
Allegedly, they intended to make an attempt to replace Xi,
after taking control over China’s political’ and law’ systems.

At last year’s 18th CCP congress
many key figures were removed.
Like the vice chairman of CCP’ Military Commission,
the former high profile’ Zhang Haiyang, and Liu Yuan.
Outside observers believe,
this was very much affected by Bo’s case.

Also, last May, Ruan Zhibo, the 62 year-old healthy deputy
commander of Chengdu Military Region, died suddenly.
Outsiders speculate that Ruan’s death might not be natural,
and due to his attempt to ‘find Bo’s allies in the military.’

In addition, there was a rumor of People’s Liberation Army
Admiral and Deputy Chief of Staff, Zhang Qinsheng,
being interdicted due to his insisting
on nationalization of the army.
Afterwards senior army generals claimed
that the matter was purely a rumor.
However, the New York Times reported last August that
Zhang Qinsheng was drunk at a military leadership banquet,
and expressed in front of Hu Jintao his dissatisfaction
of not being a member of the Central Military Commission.

The Multidimensional News network pointed out,
the CCP senior generals’ rude behavior, and Bo’s case,
made the CCP leaders very nervous
about the loyalty of the military generals.
Xi’s subsequent series of actions
are a continuation of his attempts to rectify this.

Political commentator Wu Fan pointed out, CCP’s military
did not have wars for many years, and trading of officials’ positions is very common.
The instability of the military makes the CCP more insecure,
thus Xi needs to strengthen the army after coming to power.

Wu Fan: ‘Now the military has a considerable number
of people who are dissatisfied with the army,
including those who want to escape,
because the army is very much corrupted.
The defectors are these who are against the CCP;
those with good positions enjoy them and will not escape.’

The CCP official newspaper Procuratorial Daily
commented on the new criminal provisions.
It quotes the Supreme People’s Procuratorate head’s words
that the reason of making these provisions,
is to ‘further improve the military justice system, broaden
and deepen the legal work to prepare for military struggle,
and enhance the soldiers’ sense of mission and
responsibility during wars.’

Hong Kong’s Oriental Daily News also said, this might be
a preparation for wars, so they discipline the military.
Some netizens also suspected the introduction of this
‘Provisions of Crime Standards’ is a preparation for wars.

However, Wu Fan believes this is not necessarily related to
wars, as the military should be proper even without wars.
Wu said, if the army does not go to war,
or the soldiers’ corruption cannot be controlled,
they could become bandits, bringing the collapse of both,
the army and the country.
