【新唐人2015年01月10日訊】黑龍江建三江農墾法院8號開庭審理四名法輪功學員案，但不僅沒有通知家屬，辯護律師也被「剔除出局」。當天律師們公告，成立「建三江案件法律後援團」，將對相關責任人繼續追責。同一天，也有歐洲議會議員針對「建三江案」向中共公開抗議。
建三江農墾法院1月8號秘密開庭，審理在去年「建三江事件」中被抓捕的四名法輪功學員石孟文、孟繁荔、王燕欣、李桂芳。
四名當事人的家屬中，只有石孟文的前妻劉女士和女兒衝破種種阻力，進入了法庭旁聽。劉女士說，由於法院不讓律師出庭，四名當事人在法庭上自行辯護。
石孟文前妻劉女士：「他們說挨打，怎麼（受）酷刑，他說證據呢？他們拿不出證據，因為當初在裏面被打以後，家人也見不到你，律師也見不到你，在監獄裡關押人員根本找不到證據。公訴人也好，審判長、審判員也好，你說甚麼話，都說你這是無效的。」
劉女士氣憤質問，法院這樣走形式的庭審有甚麼意義？整一大幫人虛張聲勢，結果還是法院自說自話。
辯護律師之一的王宇批評，這是公權力肆無忌憚的違法，它們強行把所謂的法律程序開庭出來，企圖以判決了事。
王宇律師：「我們八個律師都發了一個抗議，對它不通知律師開庭的違法行為進行抗議。還有，我們現在有一個公告，成立一個『建三江法律後援團』。我們要對這個案件違法性，做一些後續工作。」
王宇、劉金湘等律師在8號發出公告，宣佈成立「建三江案件法律後援團」。
公告中說，去年3月，四位中國人權律師：唐吉田、江天勇、王成、張俊傑，因解救被非法關押在「農墾總局黑監獄」的幾名公民，遭到酷刑折磨，四位律師共被打斷24根肋骨。
之後，迫於國際輿論壓力，建三江農墾公安釋放了四位律師和前往聲援的各地公民，但聘請四位律師到建三江農墾系統討說法的家屬，也就是石孟文等四名法輪功學員，卻受到打擊報復，被非法抓捕並一直關押至今。目前由農墾檢察院提起公訴，而裁判者也是建三江農墾法院。
王宇律師：「農墾系統它內部的公檢法，聽命於農墾的行政機關，它們沒有司法獨立可言。而且農墾法院，從農墾公檢法的設置上，其實是沒有法律依據的，根據《立法法》和《法院組織法》，它都沒有法律依據，都是違法的。」
劉金湘律師說，「建三江案件法律後援團」除了對農墾法院及庭審期間的非法性提出控告，還向中共人大提出建議，革除違憲的司法體制，撤銷違法的庭審。
劉金湘律師：「建三江昨天開庭沒讓律師參與，完全把律師撇開了。138接下來，律師參與二審的訴訟。然後，對建三江前期的一些違法行為進行控告、舉報。完事以後，還要繼續擴大研討，會對這一個現象深層次的內情進行探討。」
除了庭審的非法，律師們也備受刁難。
去年12月17號至19號，8位律師趕往建三江為法輪功學員辯護時，遭到司法部門的監控和跟蹤。王全璋、劉連賀兩位律師更被法庭取消辯護資格。
12月30號，7位律師在建三江法院，又一次遭到法警野蠻拉扯和無理安檢等，當晚，律師們前往哈爾濱控告建三江法院違法。
劉金湘律師：304「建三江這個案子，它這個迫害，不僅僅我們目前看到的這個迫害，實際上情況可能還要嚴重，它對當事人都這樣，對律師都這樣，那麼對當地的那些我們不知道的，迫害會厲害，對法輪功信仰者。」
歐洲議會人權委員會議員克勞斯‧布赫訥（Klaus Buchner）7號在臉書對「建三江事件」進行強烈譴責，他表示，針對農墾法院8號荒唐庭審，他已經書面向中共交涉，強烈要求保證法輪功學員及辯護律師的人身自由與安全。

Legal Backup Team To Follow Up On Jiansanjiang Case
Land Reclamation court in Jiansanjiang, Heilongjiang Province conducted a trial on the 8th of four Falun Gong practitioners without notifying the families or the lawyers. The lawyers announced on the day that a legal backup team was set up for the Jiansanjiang case to follow up on the legal protocols against law violating officials. A European Parliament member also filed a public protest to the Communist regime.
On Jan. 8, Jiansanjiang court conducted a secret hearing on four Falun Gong practitioners, Shi Mengwen, Meng Fanli, Wang Yanxin, and Li Guifang, who were arrested last year.
Among the four families, only Shi’s family (ex-wife Ms. Liu and daughter) entered the courtroom through all obstacles. Ms. Liu said that the four defendants had to defend themselves because the court banned the counsels.
Ms. Liu: “They described how they were beaten and tortured. He asked for the evidence. They had no evidence, because neither the family nor the lawyers were allowed to meet them after they were beaten. There won’t be any evidence from the defendants. No matter what they said, the prosecutor, the presiding judge and the judge just said it was invalid."
Ms. Liu was very angry and suspected the meaning of the pro forma trial. “It was all court talking with a bunch of people bluffing."
Defense lawyer Wang Yu criticizes the authorities had violated the law unscrupulously. They pushed through the proceeding and only to end it with a verdict.
Lawyer Wang Yu: “The eight of us have filed a complaint about the illegality, a trial without the presence of lawyers. We also announced a legal backup group to follow up on the officials’ violations."
The eight lawyers issued a notice on the 8th about the “Jiansanjiang case legal back up team".
The notice described that four human rights lawyers, Tang Jitian, Jiang Tianyong, Wang Cheng, and Zhang Junjie, were illegally detained during their defending activities for Chinese citizens illegally detained in the Land Reclamation case black jail. The four lawyers were tortured and sustained a total of 24 broken ribs.
Under international pressure, Jiansanjiang Land Reclamation Public Security released the four lawyers and other Chinese who went to voice solidarity. But the four Falun Gong practitioners were subjected to retaliation and illegally detained ever since. Land Reclamation Procuratorate brought up the prosecution and the referee is also Jiansanjiang Land Reclamation court.
Lawyer Wang Yu: “The legal system within the Land Reclamation takes orders from its administrative organ. There is no judicial independence. The Land Reclamation court was established without any legal basis. According to the Legislation Law and Court Organization law, the Land Reclamation court is simply illegal."
Lawyer Liu Jinxiang says that the legal backup team will file a complaint against the court and its illegal acts during the trial. They will also propose to the Chinese Communist Party Congress to eliminate the unconstitutional judicial system and revoke the illegal hearing.
Lawyer Liu Jinxiang: “Jiansanjiang excluded the lawyers in the trial yesterday completely. There was also the second trial, the lawyers will complain and report the illegal acts in those previous trials. We will also continue a forum to further discuss in a wider and deeper manner."
Other than the illegal trial, lawyers were also faced with multiple difficulties.
Between Dec. 17 and 19 last year, the eight lawyers were monitored and followed on their way to Jiansanjiang for the court trial. Both Wang Quanzhang and Liu Lianhe had their defense qualifications removed by the court.
On Dec. 30, the seven lawyers were subject to violence and unreasonable security checks by bailiffs in Jiansanjiang court. That night, lawyers filed a complaint in Harbin against Jiansanjiang court offenses.
Lawyer Liu Jinxiang: “The persecution could be far more serious than what we have seen from the Jiansanjiang case. If this is how they treat the defendants and lawyers, the persecution of those local Falun Gong practitioners could be even more severe."
Member of the European Parliament, Prof. Dr. Klaus Buchner, stated in his FaceBook that he has put in writing to the Chinese officials regarding the trial against Falun Gong practitioners and their lawyers.
He demanded the regime grant the followers and their lawyers freedom and integrity.
