【禁闻】西班牙法官 下令逮捕江泽民

【新唐人2014年02月12日讯】西班牙最高法院法官下令国际刑警组织以“种族灭绝”、“酷刑”和“反人类”等罪名,发布对江泽民的逮捕和监禁令。虽然中共外交部在2月7号要求西班牙当局,阻止对中共前领导人在西藏问题上的行为,采取进一步法律诉讼行动。但西班牙国家法院还是依据“普遍正义”原则,就支持西藏团体所提的告诉加以处理。据了解,逮捕令一旦发出,这些中共前领导人一出境,就可能遭到逮捕。

英国《路透社》报导,2月10号,西班牙高法法官伊斯梅尔•莫雷诺命令国际刑警组织,发布对江泽民的逮捕和监禁令,另外还下令逮捕前总理李鹏、政法界元老乔石、前西藏党委书记陈奎元、和前国家计划生育委员会主任彭珮云。

据报导,2006年,两个支持西藏的团体,和一名西班牙籍僧人,向西班牙法庭提起诉讼,指控包括江泽民和李鹏在内的中国前领导人,在西藏犯有“反人类罪”。

他们指控五名被告,积极执行让大批汉人定居西藏自治区的政策,并长期羁押数以千计的藏人,予以刑求和非法虐待。

伊斯梅尔•莫雷诺在他的裁决书中说:江泽民负责监督管理那些直接违法的人,所以他应该对下属在西藏行使的酷刑和其他反人权的行为负责。

达赖喇嘛西藏宗教基金会董事长达瓦才仁:“这种反人类或者对西藏文化的灭绝,类似这些现像一直都是存在,任何中国的领导人都有一份,所以国际社会有这样的方式去彰显,以及有这样的方式维护普世价值,这对我们来说当然是非常好的。”

西班牙的法律系统承认“普遍管辖原则”,也就是不管什么人在世界任何地方犯下“反人类罪”,都可以在西班牙被起诉。

达瓦才仁:“有很多的国家,因为经济的利益而放弃道义上的责任,很多这样的趋势,不太愿意去招惹中国的这样一个局势下,西班牙的法庭能够完全抛弃利益纠葛,而是从道义、从国际法或者是从普世价值的角度,对中共的邪恶提出这样的通缉以及逮捕,当然是非常了不起的创举。”

多年来,西班牙法官曾裁决犯有“反人权”罪行的国际人物有罪,并试图逮捕这些国际人物。1998年,智利军事独裁者奥古斯图•皮诺契特,就是被西班牙前法官加尔松以“普遍管辖原则”逮捕。

美国纽约城市大学政治学教授夏明:“中国政府还有一定的经济实力,在收买舆论,在全球也在不断打造它自己的形象。对中国的人权问题,无论是迫害地下教会、迫害西藏佛教徒、或者迫害新疆的穆斯林,还有迫害法轮功,如果这些所有的问题,如果西方国家没有以美国为首,形成一个比较团结的阵营,那中国政府我想基本上不会予以理睬和担忧的。”

达瓦才仁:“因为中共可以把这说成是国外反华势力等等,但是它至少对中共的一些领导人或一些肆无忌惮的侵害人权残害一般人民的官员给他们一个警钟,让他们知道,这个世界并不是你想怎么做就怎么做,会有一些正义人士盯着你。”

事实上,这不是西班牙法庭第一次向江泽民发出逮捕令。早在2009年11月28号,西班牙国家法庭已做出裁定,以“群体灭绝罪”及“酷刑罪”起诉迫害法轮功的首恶江泽民、罗干、薄熙来、贾庆林、吴官正五名中共官员。

西班牙国家法庭在历经两年详细的搜证调查后,依斯马尔‧雷诺(Ismael Moreno)法官在2009年11月通知“人权法律基金会”(Human Rights Law Foundation,HRLF),法庭同意根据诉状内容,受理起诉被告所犯下的“群体灭绝罪”及“酷刑罪”等重大罪行。

据了解,中共自从1999年对法轮功进行镇压迫害。法轮功学员在国际上先后控诉了三十名参与迫害的中共高官。其中,被控诉最多的是发动这场迫害的元凶——江泽民。

Spanish Judge Requests Interpol to Order Arrest of Jiang Zemin

A Spanish High Court Judge has asked Interpol to
issue an arrest order seeking Jiang Zemin’s arrest.
He is to be detained on allegations of
Genocide, torture and crimes against humanity.

On February 7, China’s Foreign Ministry called
on Spain to prevent further lawsuits that seek
to investigate alleged rights abuses in Tibet.

The Spanish Judge’s order is based on charges brought
by Tibetan rights groups in Spain under universal jurisdiction.
The order will lead to the prompt arrest
of Jiang in the event of him leaving China.

On February 10, Reuters reported that Spanish High Court
Judge Ismael Moreno requested Interpol to issue orders
for the detention of former Chinese President Jiang Zemin.

The order also requested the detention of China’s
former Premier Li Peng and former Politburo
Standing Committee member Qiao Shi.

In addition, it also included former secretary of CCP
Tibet Committee Chen Kuiyuan, and former State
Family Planning Commission Director Peng Peiyun.

The case was reportedly brought
by two Tibetan rights groups.

This included a Tibetan monk who holds Spanish
citizenship, charging former CCP leaders Jiang Zemin
and Li Peng with crimes against humanity in 2006.

They accused the five defendants of actively
enforcing implementation of Han population
settling in the Tibetan autonomous region.

Allegations also included illegal torture
and ill-treatment of thousands of Tibetans.

Judge Moreno wrote in the order, that “Jiang
exercised supervisory authority over the
people who directly committed abuses…
which makes him responsible for acts of torture
and other major abuses of human rights perpetrated
by his subordinates against the people of Tibet."

Dawa Tsering, Director of the Religious Foundation
of His Holiness the Dalai Lama in Taipei: “This
inhumanity and the extinction of Tibetan culture has
always existed under the rule of the Communist regime.
Every leader in the Communist regime has been involved.
Of course, it is very good for us to hear such support from
the international community to maintain universal values."

Spanish rules allow judges to pursue
cases under universal jurisdiction.
This includes the principle that crimes against
humanity can be prosecuted across borders.

Dawa Tsering: “Many countries are pursuing
China’s economy, at the cost of moral responsibility.
Under the current situation, where no country is willing to
provoke China, the Spainish court’s ruling with a warrant
to arrest the regime’s evil leaders, is a great historic act.
It discards trade, and insists on
international laws and universal values."

Reuters reported that this is the same concept
used by former Judge Baltasar Garzon.
This brought about the arrest of Chile’s former
dictator Augusto Pinochet in London in 1998.

Xia Ming, Political Science Professor, City
University of New York: “The Communist
regime has exploited its economic power.
It has bought out media to build its global image.

Regarding human rights issues in China, whether
it is the persecution of the underground church,
Tibetans Buddhists, the Uyghur Muslims in Xinjiang,
or Falun Gong, the Communist regime wouldn’t budge.
It demanded the alliance of the Western
countries, headed by the United States."

Dawa Tsering: “The CCP would always
refer this as foreign anti-China forces.
It’s a warning to Communist leaders and those unscrupulous
officials violating human rights and the general population.
There are righteous people watching."

In fact, this is not the first time the Spanish court
has issued an arrest warrant against Jiang Zemin.
As early as November 28, 2009, Spain’s National Court
ruled to charge five Communist officials for Genocide,
torture, and executing the persecution of Falun Gong.
These five officials were Jiang Zemin, Luo Gan,
Bo Xilai, Jia Qinglin, and Wu Guanzheng.

After two years of investigation of the case,
Judge Ismael Moreno notified the Human
Rights Law Foundation in November 2009.
The court accepted charges of Genocide and torture in
the case filed against five high-ranking CCP officials.
This was for their role in the persecution of Falun Gong.

The Chinese Communist regime began
to crackdown on Falun Gong in 1999.
Falun Gong practitioners in the international community
have brought lawsuits against a total of 30 high-ranking
Communist Party officials for their roles in the persecution.
Among them, the most accused is
Jiang Zemin, who initiated the persecution.
