【禁闻】后小悦悦 中国需要的是什么?

【新唐人2011年10月27日讯】继佛山女童小悦悦被车碾压死亡后,中国民众对见死不救的态度进行反思,虽然专家建议中国应该引入“不进行救助罪”或“撒玛利亚好人法”,用法律来维护最起码的社会准则。不过立法能解决道德问题吗。请看本台记者报导。

佛山小悦悦事件刚过,悲剧再次上演,23号中午,东莞市3岁男孩杜杨洋,在自家店门口玩耍时被货车撞倒碾压当场死亡。同一天下午,增城一名也叫悦悦的小女孩,在自家门口前被一辆汽车撞倒后,头部被碾过,由于伤势过重抢救无效死亡。

两起车祸中,东莞市民在事发前虽然发现不妙朝司机大喊示警。并冲向前拦车营救,但没能阻止悲剧发生。“再慢两秒钟,小杨洋就不会有事了”。

佛山小悦悦被撞路人见死不救事件,持续引起国际舆论的讨论。德国刑法规定,发生交通事故,路人应当保护现场,防止再度发生事故,并且应该呼叫救护服务,尽可能对伤者给予抢救,否则将受刑罚。

德国法学专家霍伊瑟教授向《德国之声》表示,中国的社会问题,道德上的问题只能通过刑法条文来克服。现在应该到了引入见危不救罪的时候了。

美国专家詹礼愿也认为,“好人法”将对中国社会风气和道德滑坡现象带来积极的影响作用。

目前,广东一些律师正在准备起草“撒玛利亚好人法”,从法律上制裁那些在类似小悦悦事件中袖手旁观的人,并保护那些向身处险境的陌生人施以援手的好人。

不过,中国还有一些法界人士持不同看法。

北京律师莫少平指出,小悦悦事件浮现出两方面问题,一个是良知底线的问题,一个是社会本身的问题。

莫少平:“那么道德沦丧一种表现那是什么方面原因呢?那当然有各种方面的原因,但我认为更重要的可能是这个社会本身一个原因,也就是说,不同的社会体制下,不同的社会环境下,不同的社会导向下,那么对人们道德本身,他有一种指引作用。”

莫少平表示,立法不是灵丹妙药,道德和法律相互之间有时候可以相容,但不能完全取代。

莫少平:“这也凸现一些社会问题,用立法形式来做灵丹妙药,这个本身我认为是对立法一个迷信,因为很多社会问题,不能仅仅或是不能只靠所谓立法这种方式去解决,每个社会问题就立一个法律,然后以为立了这部法律以后这个问题就能迎刃而解了,这实际是立法迷信一种思维方式。”

北京法律学者杜兆勇也持同样看法,他向《美国之音》表示,从良知来讲,法律不能解决人的内心问题,也就是法律和道德是两回事,法律只是道德的底线,它不是提升道德或者代替道德的东西。

Crushed Yueyue Not the Only Case

The death of the crushed Foshan girl, Xiao Yueyue, made
Chinese people think about their bystander effect attitudes.
Experts suggest China should have laws to protect basic
social norms, like “saving a life" or “good Samaritan.".
Can this moral problem be solved through legislation?

After the incident of Xiao Yueyue in Foshan City,
other similar tragedies happened again.
On October 23, a 3-year old boy, Du Yangyang, was hit
and crushed to death by a van at his family shop.
The same day, another little girl also named Yueyue from
Zengcheng City, died after her head was crushed by a car.

When these car accidents happened, citizens in Dongguan
City, aware of the danger, shouted to warn the driver.
They ran towards the vehicle and tried to stop the car.
But they could not stop this tragedy.
“Du Yangyang would’ve been ok
if the car was two seconds slower."

Xiao Yueyue was crushed by a car but bystanders’ neglect
has brought about a worldwide discussion.
German laws state, passers-by should protect the area
in a case of traffic accident to prevent more from occurring.
Bystanders must call an ambulance,
otherwise they will face prosecution.

Legal expert Dr. Robert Heuser from Germany, said to
The Sound of Germany that China’s social and moral problems can only be solved by law.
He insisted that now is the time
to introduce a law of “saving a life."

Experts agree that the “good Samaritan law"
will have a positive effect on social morality.

Guangdong lawyers prepare a “good Samaritan law" draft,
to punish bystanders and protect helpers in Yueyue-like cases.

However, there are lawyers who hold different views.

Beijing lawyer Mo Shaoping points out that Yueyue’s case
reflects two issues: morality’s bottom line and society’s problems.

Mo Shaoping:"What is the reason for this declined moral
standard? The answer involves a variety of issues.
The major reason lies with the society itself.

There is a difference between social systems, environments,
and orientations. This plays a guiding role to morality itself."

Mo said the legislation isn’t a panacea, ethics and law
can complement each other, but are not substitutable.

Mo Shaoping: “The incident also highlights social problems.

To take the form of legislation as a panacea
is a superstition towards legislation itself.
Many social problems can’t just be solved
by establishing a new law.
Law makers think new laws can solve every new problem,
which in and of itself is a kind of superstition."

Beijing’s legal expert, Du Zhaoyong, has a similar view.

He said to VOA, that from the point of one’s conscience,
the law cannot solve the problems of the human mind.
Du thinks law and morality are two different things,
the law is to restrict the base line of the moral standard, but it cannot enhance or replace the morality itself.
