【新唐人2013年11月20日訊】三中全會是中國共產黨的會議，中共在它的會議上，卻做出了一系列所謂關係到國家前途和命運的改革措施。專家指出，中共一切都亂套了，連新成立的兩個權力機構是黨的部門，還是政府部門，它自己都沒有搞清楚。實際上它所做的《決定》本身，就是違背憲法的行為。
根據中共竊國後自己制定的《憲法》，中國的立法機關是全國人民代表大會及常務委員會，制定、修改和廢除法律，必須由全國人民代表大會及常務委員會通過。
11月12號，中共18屆三中全會結束後，當天就由中共第十八屆中央委員會通過了所謂《中共中央關於全面深化改革若干重大問題的決定》，其中包括土地、勞教制度、計劃生育政策，多項有關涉及法律法規方面的改革。並且成立兩個新的權力機構﹕「國家安全委員會」和「深化改革領導小組」。
美國紐約「民主大學」校長唐柏橋指出，中共一切都亂套了，連它自己都沒有搞清楚新的權力機構，是黨的部門，還是政府部門﹖
美國紐約民主大學校長唐柏橋：「它只能屬於他們黨的建議，黨它沒有權利去做任何修改法律的事情，中國的立法機構是人大，它哪怕走一下形式，他也要等到明年三月份人大通過，因為這是屬於法規，黨怎麼能修改國家、政府的法規呢﹖包括成立國家安全委員會，它必須要通過憲法確定。」
唐柏橋指出，中共的所謂「廢除勞教制度改革」，也是在國內民眾和國際社會的強大壓力下，作出的一個掩人耳目的幌子。實際上，中國有很多勞教所，改成了監獄，而用「戒毒所」，「法治矯正中心」，「精神病院」等來取代勞教。中共非法迫害民眾的手段更加隱蔽和殘酷。
唐柏橋：「現在開的這個會，是中共開會，跟中國政府不是一回事，跟中國就更不是一回事，中國是個國家概念，中共現在是凌駕於中國政府，中國政府指的是國務院這一套系統。中華人民共和國的《憲法》裡面是沒有關於黨的部分的，黨委屬於甚麼權利機關，《憲法》裡沒有，是違憲的。」
在西方社會，各黨派的組織是屬於非政府組織，純粹是民間機構，只是在選舉之前，聚集在一起，進行交流，推選出自己的候選人。而且黨派所使用的資金，來源於募捐，不能用納稅人的一分錢。
紐約城市大學政治學教授夏明：「西方國家的政黨，是自由進出的，它是一個全民黨，投票的時候，我選擇任何黨，我就成了它的黨員了，在選舉之前它會把它的政綱制定出來，通過政綱贏得老百姓的投票，一旦選舉產生結束以後，執政黨的功能基本上就失去了，他們任職後，他們就組成政府，不受黨的領導的。」
中國法學專家賀衛方、何兵等曾經指出，共產黨組織並沒有在民政部門登記註冊，是個不合法的組織。
可是這個非法的黨組織卻在中國無所不在，無所不管。中國民眾一直以來也看不到「中國共產黨」的財政預算，只有國家的預算，地方政府預算，企業預算。而黨的開銷支出，卻由行政部門的開銷中付出，並且不單列開支。
自從國際共產主義破產之後，中共改祭出「民族主義」和「愛國主義」的大旗。而當西方國家批評中共時，中共會稱西方國家為「反華勢力」。如果國內民眾反對中共獨裁暴政，中共動輒冠以「反政府、顛覆國家政權」的罪名。如果海外華人譴責中共，它就說你「不愛國」。
而中國，有著5000年的文明歷史，中共自49年竊國後，到現在不過才60多年。
近年來，海外有識之士，展開了有關「中共不等於中國」的討論。學者指出，由於中共通過各種血腥手段，用國有的名義，把中國百姓的私有財產和國家資源據為黨有，而且從小灌輸中國民眾所謂「黨媽媽」觀念，讓中國民眾產生了「愛黨就等於愛國」的錯覺。

Violate the Constitution
The Chinese Communist Party (CCP) made a series of rules
during its Third Plenary Session, which claim to decide the
future and the fate of the country.
Experts point out that the CCP is in a complete mess.
It is not even clear whether the two newly established branches
belong to the party or the government.
In fact, its measures are against the constitution.
According to the CCP’s Constitution enacted after it took
over the country, China’s legislature is the National People’s
Congress (NPC) Standing Committee.
Enacting, amending or repealing laws must be passed by
the NPC Standing Committee.
On November 12, the CCP’s Third Plenary Session of the 18th
Central Committee concluded.
The same day the 18th Central Committee passed the so-called
CCP Central Committee’s Decisions of Several Important Issues
on Comprehensively Deepening the Reform.
It includes laws and regulations involving various aspects of
the reforms, such as land system, family planning, labor camp
system.
It also formed two new institutions of power: “National Security
Council and Deepen the Reform Leadership Team."
U.S. New York Democracy University President Tangbo Qiao
pointed out that the CCP is all messed up.
It did not even figure out if the new institutions belong to
the party or the government.
Tang Baiqiao: “It is only the CCP’s suggetions. The CCP
does not have the right to change the law.
China’s legislative body is the NPC. It has to wait until
March 2014 for formality. It is the regulations.
How can the CCP modify the law of the government?
The establishment of the National Security Council must be
validated by the constitution."
Tangbo Qiao pointed out that CCP’s so-called “Abolition of
Reeducation through Labor System Reform" is a pretense to
deceive the public facing pressures inside and outside China.
In fact, a lot of labor camps were turned into prisons, or were
replaced by addiction treatment centers, legal correction
centers and mental hospitals, etc.
The CCP’s illegal persecution of people has
turned to be more subtle and cruel.
Tang Baiqiao: “The session was a CCP meeting, not for the
Chinese government nor for the people. China is a country.
The Chinese government is the State Department and system.
The CCP is now above the Chinese government.
The Constitution of the People’s Republic of China does not
include the CCP. It is a violation of the Constitution."
Political parties are non -governmental organizations
in the western society.
They only gather before the election to elect their candidates.
Their funding comes from donations.
They cannot use any money from the taxpayers.
University of City of New York political science professor
Xia Ming: “Political parties in western countries are free to
come and free to go.
One chooses a party to vote and will be its member.
The parties make their political agenda before elections.
The elected party will form the government and will not be
led the political party once the election is done."
Chinese legal experts He Weifang, He Bing and others
once pointed out thatthe CCP does not have any registration.
This means it is not a legitimate organization.
However this illegal party is everywhere in China.
It controls everything.
Chinese people have never seen the budget of the CCP.
There are budgets for central and local governments and business.
The party’s overhead expenses come from executive branches.
There is no separate book to track these.
Since the collapse of the international communism, the CCP
resorted to the ‘nationalism’ and ‘patriotism’ banners.
When Western countries criticize the CCP,
the CCP would call them as ‘Anti-China Forces’ .
If people in China oppose the CCP’s tyranny,
the CCP labels them as ‘Anti- Government’.
If Overseas Chinese condemn the CCP ,
the CCP refers them as ‘unpatriotic.’
China has 5,000 years of civilization.The CCP has ruled
China only for a little over 60 years.
In recent years, some overseas people launched discussions
on “CCP Does Not Represent China".
Scholars pointed out that the CCP has taken away properties
belonging to people and China to itself.
It brainwashes people from childhood that the CCP is like a
mother, and that loving the CCP is being patriotic.
