【禁闻】超期羁押不能见人 外界忧郭飞雄安危

【新唐人2013年10月11日讯】广州维权人士郭飞雄,被中共当局以所谓的“涉嫌聚众扰乱公共场所秩序罪”,羁押60多天了,早已超过刑事拘留的30天上限。但是到目前为止,他的家属和辩护律师都无法与他会面,更不知道他的人身是否无恙。学者出身的郭飞雄,长期致力于维权工作,多次被抓入狱,出狱后还是不改初衷,持续为推动公民社会自主成长,推动履行公民政治权利而努力。这次各界对郭飞雄因践行公民权利再次遭到拘捕感到震惊,有超过300多海内外人士联署,要求当局立即释放郭飞雄,中国120多位维权律师更是成立法律后援团,声援郭飞雄。

被中共当局以奇怪的罪名罗织入狱,这对于维权人士郭飞雄来说,已经不是第一次了。

今年8月8号,郭飞雄无故失踪,10天后,外界才知道中共当局以涉嫌“聚众扰乱公共场所秩序罪”又一次抓他入狱。辩护律师隋牧青认为,郭飞雄这次被逮捕的直接原因,是他参与了今年年初《南方周末》的维权活动。

在确认郭飞雄已被广州警方秘密抓捕后,国内外各界人士纷纷发表声明谴责。而为了督促有关方面公开、公正、公平处理郭飞雄一案,120位律师串起正义联线,特别发起成立“郭飞雄案法律后援团”。

广东律师隋牧青:“看守所那边为了阻挡我会见,连大门都不让我进,那么现在因为这个事情国内外的舆论都很震撼,律师界的同仁也都很气愤,因为这个是侵犯律师的职业的权利,那么现在我们同行都会前来支援,以某些方式前来支援。”

早已超过法定的羁押期限,律师多次到看守所要求会见还是被拒,律师们觉得事有蹊翘,他们担心郭飞雄的安危。

隋牧青:“如果你(中共)不宣布逮捕,你就应该变更强制措施,或者是无罪释放,那么,现在是警方没有任何说法,也没有对家属有任何的通知,这都是违法的。他这样不给会见,太违背常理,因为国内类似这样的案件基本都给见,只有他不给见,而且这么长时间不给见,这就太不正常,因为我们一般就觉得这可能出了比较大的事情,最大的可能就是刑讯受伤。”

作为“郭飞雄案法律后援团”成员之一的唐吉田律师,希望能结合大家智慧和力量,尽快让郭飞雄恢复人身自由。

中国维权律师唐吉田:“我们是希望通过两位辩护人的努力,以及我们的一些跟进支持,让社会大众包括海外的一些朋友,关注郭飞雄以及与郭飞雄相类似的朋友的处境,进一步认清官方对追求公民权利和政治权利的这些人士,这种大面积、大规模的刑事追诉,所带来的危害可能造成的严重后果。”

毕业于上海“华东师范大学”的郭飞雄,曾经入选香港《亚洲周刊》2005年“风云人物”。他自2003年起参与中国的维权活动,包括为广东太石村罢免村官提供法律咨询、呼吁释放中国维权律师高智晟,介入广东乌坎选举,以及参与李旺阳死亡真相调查等。

唐吉田:“我觉得郭飞雄先生,他长期以来致力于推动中国社会向理想的方向去发展,让公民权利和政治权利得到保障,让这个社会更为和平,更为理性。”

2009年4月,郭飞雄还在广东梅州监狱服刑,他的妻子张青和一双儿女被迫离开家乡,辗转来到美国,并接受美国的政治庇护。如今他们一家人两地相隔,只能透过媒体报导或大陆亲人和律师的传达,了解郭飞雄在狱中的情况。

今年8月,张青抱着一丝希望,写出第九封信给中共的最高领导人,她希望人权和法治在中国受到起码的尊重。

然而,随着这九封信的石沉大海,郭飞雄的妻子也只能隔海呼唤﹕“郭飞雄你要坚强的活下去!”

Fearless Guo Feixiong fights for justice without submitting to force

Guangzhou civil rights activist Guo Feixiong was placed
in custody for more than 60 days by communist authorities
for the so-called crime of assembling crowds
to disturb public order.
He has already been detained for 30 days more than
the maximum, but his family and defense counsel
are still unable to meet with him.
His safety is in question.

Guo, who comes from a scholarly background,
is devoted long-term to maintaining legal rights.
Even though he was arrested and imprisoned a couple
of times, after his release he continues to promote
civil initiative, growing and fulfilling civic
and political rights.
It’s shocking that Guo was arrested again
due to fulfilling civil rights.
His friends from China and abroad collected more than
300 signatures to request that authorities immediately release Guo.
More than 120 defense lawyers got together
to support Guo Feixiong.

It’s not the first time Guo was imprisoned on charges
involving strange accusations by the Chinese authorities.

This year, on August 8, Guo Feixiong disappeared
without any reason.
10 days later, the outside world found out that the Chinese
authorities imprisoned him again on suspicion of
assembling people to disturb public order.

Defense lawyer Sui Mu Qing believes that the immediate
reason for Guo Feixiong’s imprisonment is because he
participated in a rights defense activity from “Southern
Weekend" early this year.

After confirming Guo Feixiong had been arrested secretly
Guangzhou police, people at home and abroad all issued
a statement condemning it.

In order to urge the parties dealing with Guo Feixiong’s
case to do so in a fair, just and open manner, 120 justice
lawyers initiated the establishment of a legal support group
for Guo’s case.

Guangdong lawyer Sui Muqing: “The detention center
doesn’t allow me to visit in order to prevent me from
meeting with him.

His imprisonment shocked the public at home and abroad.
Lawyers and industry colleagues are also very angry
because it is a violation of lawyers’ professional rights.
Our lawyers will all come to support in some way."

Guo Feixiong’s detention already exceeded the legal period.
Lawyers think something fishy is going on because their
requests to visit were refused a couple of times.
They are worried about Guo Feixiong’s safety.

Sui Mu Qing: “It is illegal for the police to imprison without
reason and without notifying the family.
It’s quite abnormal not to allow a meeting in such a long time
unless something happened or he is injured due to torture."

As a member of the legal support group for Guo’s case ,
lawyer Tang Jitian hope to gather the wisdom and
strength to restore Guo Feixiong’s liberty as soon as possible.

Chinese human rights lawyer Tang Jitian: “By the efforts
of two defenders and the fact that from our follow up,
the public, including some overseas friends, are concerned
for Guo Feixiong and other people in similar situation.
So they can further understand the large scale damage
to the penal prosecution rights of the people in pursuit
of civil and political freedom, and the serious consequences."

Guo Feixiong, who graduated from Shanghai East China
Normal University, was elected as 2005’s Person
of the Year by Hong Kong’s Asia Week.

Since 2003 he has been involved in China’s human rights
activities, including providing legal counseling
to the recalled village officials, appealing to release
Chinese human rights lawyer Gao Zhisheng, getting
involved in Guangdong Wukan elections and participating
in the investigation of the truth of Li Wangyang’s death.

Tang Jitian: “I think Mr. Guo Feixiong has been committed
to promoting China’s social development ideally
and guaranteeing civil and political rights.
He is trying to make this society more peaceful and rational."

Since April 2009, Guo Feixiong has been doing time
in Guangzhou Meizhou Prison.
His wife, Zhang Qing, and two children, were forced
to move to the United States and accepted political asylum.
Now his family can only get his information through media
reports or relatives and lawyers’ communication abroad.

In August of this year, Zhang Qing holds a glimmer of hope;
she wrote her ninth letter to the CCP’s top leaders
requesting respect for human rights and the rule of law
in China.

However, with these nine letters having disappeared forever,
Guo’s wife can only call him from across the sea,
“Guo Feixiong you have to live with a strong will
and survive!"
