【新唐人2013年08月03日訊】中國大陸大連中院原定4月12號非法開庭審理的，所謂「安鍋案」被取消後，改在了6月21號。8月2號，大連西崗區法院對車忠山等11名法輪功學員再次非法開庭審理。但因為過程中辯護律師被毆打，所有辯護律師再次退庭表示抗議。
8月2號早上8點半，大連西崗區法院，對車忠山等11名法輪功學員安裝《新唐人電視臺》衛星接收器進行非法開庭審理，到場的辯護律師包括：程海、梁小軍、張磊、王全章、王興、趙永林、陳建剛等12人。
根據辯護律師轉述，在法院內的警察、司法警察加上國保，穿便衣的特務和便衣警察，人數至少有3百人以上。
開庭中，辯方律師提出辯證申請。
北京律師陳建剛：「按照刑事訴訟法的規定，控方辯方必須提供證據原件，除非是不便於搬運、不易於保存，否則必須提供證據原件，因為這個案子就是證明，他們認為的定論點就在於，安裝的接收器可以接收新唐人並且是僅僅接收《新唐人》，我們要求當庭進行指證，我們到現在為止，沒有看到控方提供的任何一份證據原件。」
陳建剛律師表示，辯方到目前為止，都沒有看到控方提供的任何證據原件。開庭時，法官明顯的不聽辯方任何人的辯護意見，而提出來的問題，也得不到法官的答復，法官甚至不讓他們發言。
陳建剛：「這個案件從頭到尾，沒有一個地方是能證明被告人是有罪的，我們對這些證據以及庭審中的程序，充滿了置疑。我們認為違反法庭程序，要求向法庭表述做為辯護人應該履行的職責，發表辯論意見，但是被法庭制止。」
律師們認為，既然法院是公開開庭審理，那麼按照《刑事訴訟法》的明確表述，任何東西都必須在法庭上得到指證。
北京律師程海告訴《新唐人》，他在審理現場要求出示，「安鍋」可以接收到《新唐人電視臺》的鑑定，和對看了《新唐人電視臺》節目之後會犯罪進行舉證﹔另外，他還要求出示，指控法輪功學員「安鍋」的證據原件，但都遭到審判長的拒絕，甚至遭到警告。程海因此決定退庭並提出投訴。
北京律師程海：「退出以後，出來就有一個警察模樣的人，穿著白襯衣，1米8，30多歲，對我進行毆打，掐我的脖子，扭我的手腕，手指頭掐啊掐，掐出血。左手這個大拇指的血弄到身上，手腕多處紅腫。然後就把我押到法庭對面的房間裏面，限制我的人身自由，不讓我去投訴。後來梁小軍律師他們出來進行營救，才得以脫身。」
4月12號在大連中山區法院開庭審理時，程海律師就曾遭到警察毆打，這是他第二次被毆打。
因為程海律師在法庭門口被法警及便衣毆打，於是全體辯護律師當場決定退庭抗議。
北京律師唐吉田：「在出來的時候，大門口有法院的工作人員攔他們，我親眼看到，不讓他們出來。」
陳建剛：「程海被這邊的警察毆打了一次，所以我們要確保他的人身安全，但是法警當庭對我們開始武力威脅，推搡梁小軍律師，辯護人、辯護律師 人身安全得不到任何保障，我們沒有辦法，只好退庭。」
律師們認為，法輪功學員沒有危害社會的行為，中共當局也沒有任何法律明文禁止收看《新唐人電視臺》的節目，當局這麼做的目的，是為了威脅律師並使得法輪功學員得不到法律援助。

Lawyers Collectively Quit Court in Protest
A trial of 11 Dalian Falun Gong practitioners for
installing satellite dishes was changed to June
from the scheduled date in April.
On 2nd August, a local district court held the 2nd trial.
During the trial, however, a defense lawyer was beaten,
the lawyers thus quitted court in protest.
On 2nd August, Dalian Xigang District Court held
a trial involving 11 local Falungong practitioners who
were accused of installing satellite dishes to watch NTD.
12 defense lawyers appeared in court.
The defense lawyers revealed that over 300 police including
plainclothes officers, stood guard in the court building.
In court, the defense lawyers asked for giving arguments.
Beijing lawyer, Chen Jiangang: “According to the law,
both the prosecutor and the defendant shall
provide original proof, unless the evidence cannot
be handled or is hard to preserve.
This case deals with installing satellite dishes for the
purpose of receiving NTD or solely receiving NTD.
We asked them to present proof of this accusation.
But they failed to reveal any evidence.”
Lawyer Chen says that so far, the defendants have not
yet seen any original evidence from the prosecutor.
During the trial, the judge paid no heed to the lawyers』
defense, nor did he answer their questions.
The judge even forbade the lawyers to speak.
Chen Jiangang: “The prosecutor showed nothing to
prove the guilt of the defendants.
We think their alleged evidence and
the trial procedure was against law.
We asked to state in court our defense lawyers』 duties,
and the right to give arguments, but were refused.”
The lawyers say, since it was a public hearing,
any charge shall be testified in court according to law.
Beijing lawyer, Cheng Hai, tells NTD that in court,
he asked the prosecutor to provide evidence.
The evidence should include appraisal reports that prove
satellite dish installments can receive NTD signals.
As well as the appraisal reports that prove,
watching NTD would lead to crimes.
Lawyer Cheng also asked for the original evidence of
“installing” satellite dishes by Falun Gong practitioners.
The presiding judge refused all these requests and
even warned lawyer Cheng.
Cheng thus quit court, and filed a complaint.
Beijing lawyer, Cheng Hai: After I quit court, a policeman,
in his 30s, approached with the intent to attack me.
He pinched my neck, twisted my wrist, and made
my fingers bleed. I had many swellings all over the body.
He detained me in a house opposite to the court.
Later, Liang Xiaojun and other lawyers came outside
and rescued me from there.
Back in April, lawyer Cheng Hai, who defended
Falun Gong practioners, was assaulted by the police.
In view of lawyer Cheng』s being beaten by court police
and plainclothes officers outside the court,
all the defense lawyers quit court in protest.
Beijing lawyer, Tang Jitian: I witnessed that
the court staff stopped them from going outside.
Chen Jiangang: “Cheng Hai was beaten by police,
so we had to ensure his personal safety.
But in court, the court police openly threatened us,
they pushed and shoved lawyer Liang Xiaojun.
No personal safety was available to the defenders and
the defense lawyers, so we had to quit court in protest.”
The lawyers believe that Falun Gong practitioners
have not committed any social harm.
The communist authorities have never expressly banned
Chinese citizens from watching NTDTV programs.
The lawyers say that by doing this, the communist
authorities aim to threaten lawyers, and to prevent
legal aid being granted to Falun Gong practitioners.
