【新唐人2013年05月23日讯】中共机关刊物《求是》杂志属下的半月刊《红旗文稿》刊登署名文章，指出：宪政的关键性制度元素和理念只属于资本主义，而不属于社会主义制度。大陆学者对这种文革思维逻辑感到惊讶和好笑，也对文章可能预示中共高层将收紧政治开放而感到担忧。
文章的题目是《宪政与人民民主制度之比较研究》，文章的作者是“中国人民大学”法学院教授杨晓青。
文章一开头就表示，近来中国社会上和学界有关“宪政”的呼声抬头。一些人还提出在中国实行西方宪政的基本理念和基本主张，认为“中国梦即宪政梦”，甚至还有人论述了“社会主义宪政”的概念。但杨晓青认为，“宪政”不属于中国共产党推行的“社会主义人民民主制度”。
“北京外国语大学”国际传播研究中心主任乔木表示，杨晓青的思维和话语结构，完全是阶级斗争意识形态的产物。乔木说，就连中共高层领导人历来，表面上也是肯定宪法和宪政的。
乔木说，在今天的中国，不管现实如何艰难，但是既然有这个宪法，人们还是希望依宪治国。但是杨晓青的文章公然推翻全世界的文明发展演进，压制人们对宪政的追求。他对于出现这样逆潮流而动的言论，觉得非常难以理解。
北京外国语大学国际传播研究中心主任乔木：“最近突然发了好多莫名其妙的文章，让人匪夷所思，我不知道是一种偶然，还是新领导人上台以后一种思想和舆论方向的一种导向。如果说一般的网站比如《乌有之乡》或个人的博客，推出这样的观点，不需要做太多的追究。但是从红旗文稿它这个背景来说，不能不让人警惕，到底怎么走？我有这个担心。”
在去年12月4号纪念宪法公布30周年大会上，习近平表示，要恪守宪法原则、弘扬宪法精神、履行宪法使命，并且强调，宪法的生命在于实施。乔木认为，习近平的这些讲话体现的也是宪政思想。现在高层背景的刊物发表杨晓青的这篇文章，跟习近平的讲话互相矛盾，令人困惑和担忧。
北京注册会计师杜延林表示，杨晓青的文章如果是出现在文革时期，倒是不奇怪。但是放在今天的时代，就令人感到好笑。
北京注册会计师杜延林：“我就很奇怪了，那中国的宪法是个什么东西呢？中国为什么要制定一个宪法呢？我就很奇怪，她列举的社会主义元素到底是什么？那么这个社会主义元素到底是导致了中国走向文明还是回到文革那种状态？或者更干脆的说，所谓的人民民主专政理论要再提的话，那我们就自然联想到朝鲜。”
杜延林表示，随着柏林墙的倒塌，所谓社会主义阵营和社会主义理论实践，已经被证明是一个失败的结果，那么这些元素在现代这样一个文明的社会里，到底能带来什么？
杜延林：“这篇文章如果是官方授意出笼的话，那恰恰就说明了那些寄希望于中共高层领导人，新一届领导人进行改革或者走一个温和改革路线的知识份子，对他们又是泼了一盆凉水。这种幻想可能是太天真了。因为当中国共产党从一个意识形态政党蜕变成一个利益政党以后，它就更难以放弃自己的既得利益和手中的权力，而去进行所谓的改革。 ”
杜延林表示，杨晓青的文章可能进一步印证了：今天共产党的意识形态并没有太大的变化。

CCP Magazine – Xi Jinping’s Remarks Unconstitutional
The Chinese Communist Party (CCP) magazine
Hongqi Wengao published an article, insisting
that key elements of the system and ideals of the Constitution
belong to the capitalism system, not to socialism.
Scholars are surprised and feel queasy about this
Cultural Revolution ideology.
They are also worried that the article fore-warns that
the CCP’s high-level will clamp down on political openness.
constitutional and the people’s democratic systems".
The article was written by Prof. Yang Xiaoqing
in Renming University of China, law school.
The article begins, that recently, the voices for
the constitutional system are rising up from the community and academic field.
Some people suggest using western countries’
constitutional system and philosophy and basic principles.
Some of them claim that:"China’s Dream
is the Dream of having a Constitutional System".
Some people even discuss the concept of the
“socialist constitutional system".
However, Yang Xiaoqing believes that the constitutional
system doesn’t belong to the socialist democratic system that the CCP has promoted.
Qiao Mu, director of International Communications Research
Center of Beijing Foreign Language University commented.
He said that Yang Xiaoqing’s thinking and words are
completely a class conflict ideology.
Qiao said that on the surface, all former CCP leadership also
accepted the Constitution and the constitutional system.
Qiao Mu said that today in China, no matter how difficult
the current situation is, people still want to see the rule of law and justice control the country.
However, Yang Xiaoqing’s article blatantly overthrows
the process of world civilization, and the
suppression of people’s pursuit of the constitutional system.
Qiao found it was very difficult to understand Yang’s opinion.
Qiao Mu: “Recently, they published many strange articles.
I am not sure if it is just a coincident or is the new
leadership’s thought or designed to mold public opinion.
If it is published by Wuyouzhixiang (a website that
promotes Mao Zedong’s ideology) or an individual blog, we don’t need to pay much attention.
But, it is published by Hongqi Wengao magazine with
it’s CCP background – we need to be alert.
What is the real plan? I am worried."
On December 4, 2012, at a meeting to commemorate the
30th anniversary of the current Constitution’s declaration,
Xi Jinping said that we must abide by constitutional
principles, carrying forward the spirit of the Constitution,
and to fulfill the mission of the Constitution.
Xi stressed that the anima of the Constitution is implementation.
Qiao Mu believes that Xi’s remarks are constitutional thought.
But with the magazine’s high-level background publishing
Yang’s article critical of Xi’s words, it is confusing and a cause for alarm.
Du Yanlin, chartered accountant in Beijing said that
Yang’s article wouldn’t be any surprised if it was published in the Cultural Revolution era.
But it is ridiculous to turn up now.
Du Yanlin, Beijing Chartered Accountant:
“I am very surprised. What is China’s Constitution?
Why did China make a Constitution? I feel strange.
What do Yang’s socialism elements refer to?
The socialism elements in the end may lead China
to civilization or a return to the Cultural Revolution?
Generally speaking, if the so-called people’s
democratic dictatorship is mentioned again,
we will naturally think of North Korea."
Du said that following the Berlin Walls’ collapse, the
so-called socialist camp and practices proved to be a failure.
Then what outcome will these elements bring to
current civilized society?
Du Yanlin:"If this article was deliberately published
with official approval,
it painfully indicates that people who put hope on the CCP’s
high-level leadership or wish the new leadership to reform,
or for intellectuals who encourage moderate reform,
they will feel like their hopes are being dashed.
This concept may be too naive. But since the CCP has
transformed from an ideological party to an interest group,
it is now even more difficult to give up its interest,
its taste for gain and power, instead of carrying forward with reform."
Du said that Yang’s article further proved that
today’s CCP has not changed much."
