【禁闻】“钱云会事件”翻版 强拆再酿悲剧

【新唐人2011年7月14日讯】大陆强拆悲剧不断,“钱云会事件”大家记忆犹存,如今在江西又发生了村民因为阻止当局强拆,遭挖掘机碾死的事。有上千名村民抬尸抗议,造成当地交通要道一度中断。对此,广东律师刘天军表示,中共官员法律意识淡薄,以及征地强拆的官僚意识,导致悲剧不断上演。

曾经入选2009年全省十大和谐村庄的江西省赣县茅店镇洋塘村,11号惊传地方当局为了征地强拆,涉嫌将阻止施工的村民谢绍椿推倒在挖掘机下碾死,谢绍椿死状惨烈。当天晚上,上千村民抬着尸体到323国道和高速公路上抗议,造成当地交通大乱。当局派出警力镇压,并警告村民不得上访,否则“后果自负”。

江西赣县茅店镇村民刘女士:“像他们这样处理事情,有点太不合理了。他们要征地是可以,但他一定要把钱弄清楚来,弄好来!这样村民也不会去闹事,是吧!”

死者谢绍椿的叔叔谢本康向《美国之音》表示,12号凌晨他赶到现场协助处理事件,看到特警、武警,见人就打,见人就抓。他的车被扣,还被诬陷是拉人去聚众闹事。

“民生观察工作室”负责人刘飞跃表示,江西省有关当局处理谢绍椿被碾死事件的手法,是中国各地当局维稳的一贯手法。

刘飞跃(“民生观察工作室”负责人):“是什么原因造成这样惨案一再发生,就注意到这是征地拆迁引起的一个悲剧,这是暴力造成的一个不该发生的一个事件,为什么这个事件一再发生,我想在政府方面他们有很大的责任,我们觉得政府方面应该好好反省,应该终结。”

《自由亚洲电台》报导,罗坑村窑前组的一位村民披露,谢绍椿是在前一天被人塞入挖掘机碾死,当时有两个老妇人正好在那片油菜地看到了,她们还听到谢绍椿喊救命。

谢本康指出,挖土的现场跟压死人的地方相差十七米,等于他(司机)是有意开着挖掘机去压死人的。

广东律师刘天军:“根据当时的客观条件和地形,他是应该能够判断是有人的,而且不规劝继续施工,明知可能他这种继续开动挖土机的行为,很有可能导致发生人家死亡的后果,他仍然对这种死亡后果持一个放任的态度,甚至故意让人家出现死亡的结果,不管是两种情况,故意也好或是放任让人家出现死亡的结果也好,在法律上都构成故意杀人的嫌疑。”

刘天军律师还认为,中国有些地方当局部门,对法律意识淡薄,还有强征地、强拆迁的官僚意识在里面,导致各地经常发生因强拆造成人命事件的发生。

就在10号晚上,负责河北省邯郸市邯山区拆迁的区长张海忠,被发现遭割喉陈尸在办公室。据《南方都市报》的消息,张海忠是拆迁的强硬推进派,他的死可能与拆迁工程有关。
不过,公安部门两天后迅速的公布调查结果,说张海忠患有重度抑郁症,他是触电、割喉双料自杀。

网路上也引发张海忠自杀的讨论,有人认为他是被拆迁户报复,也有人说他是因为拆迁利益分赃不匀被杀。

更有网民认为,民间反抗强拆“已经进入暴力抗争的阶段”。

Another Possible Demolition Murder

Demolition-related tragedies constantly occur in China.
Qian Yunhui’s murder case still lingers in people’s memories.
Another villager in Jiangxi was crushed to death by an excavator
during a forced demolition by local authorities.
Thousands of villagers carried his corpse to protest.
Guangdong-based lawyer Liu Tianjun said that
the Chinese Communist Party (CCP) officials’ lack of legal consciousness has led to constant demolition tragedies.

Yang Tong Village was named one of the top ten harmonious villages
in Jiangxi Province in 2009.
On July 11, 2011, shocking news broke out.
It is rumored that to get rid of a villager Xie Shaochun,
who tried to stop forceful demolitions,
the local authorities crushed him with an excavator.
In the evening, thousands of villagers carried Xie’s body
to protest on National Highway 323, causing traffic chaos.
The authorities sent police to repress the villagers,
who were warned to not petition or to petition “at their peril."

Villager Ms. Liu: It is too unreasonable for them (the authorities)
to handle things like this.
They can acquire lands, but they should prepare money to buy it first!
If that were the case, the villager wouldn’t cause trouble, right?!

The late Xie Shaochun’s uncle Xie Benkang told Voice of America
that in the early morning of July 12,
he went to the scene and saw the special duties unit
and armed police beating and arresting all pedestrians in sight.
Xie Benkang’s car was detained,
and he was falsely accused of gathering people to riot.

Liu Feiyue, director of Civil Rights & Livelihood Watch,
said the way, in which Xie Shaochun was crushed,
is a common method used by all Chinese local authorities to “maintain stability”.

What causes such tragedies to take place again and again?
This is a tragedy caused by land acquisition and resettlement.
It is violence-induced tragedy that should not take place.
I think that the government is responsible for these recurring incidents.
We feel that the government should carefully reflect on these incidents and end them.

According to Radio Free Asia, a villager from Luo Keng Village revealed that
Xie Shaochun was stuffed into the excavator and crushed.
Two old ladies happened to be at the scene, and they even heard Xie yelling for help.

Xie’s uncle Xie Benkang pointed out that the excavation site
was 17 meters away from the scene.
This means that the operator intentionally drove the excavator to crush Xie.

Guangdong-based lawyer Liu Tianjun:
By analyzing the conditions and the terrains,
we think that the excavator operator should know that
he might crush someone if he continued to operate the machine.
However, the operator had an indifferent attitude about someone’s death,
and he deliberately let a person die.
The excavator operator is suspected of murder.

Liu believes that the lack of legal consciousness and
a strong bureaucracy sense of some Chinese local authorities have led to
frequent deaths caused by forced demolition incidents.

Zhang Haizhong, the head of Hanshan District of Handan City in Hebei Province,
is responsible for the demolitions.
On July 10, Zhang was found dead in his office with his throat cut.
According to Southern Metropolis Daily,
Zhang was a hard-liner in promoting demolitions.
His death may be related to the demolition projects.

However, the police soon disclosed its investigative results,
saying that Zhang suffered from severe depression,
and he committed suicide by electrocuting himself and by cutting his own throat.

Zhang’s death has sparked discussions online.
Some believe that he was retaliated against by victims of forced demolitions.
Some say he was killed by his partners that are dissatisfied
with the demolition spoils distribution.

More netizens believe that the people’s resistance of demolitions
“has entered a stage of violent protests."
