【禁聞】市長夫人臀部被刺引發的奇案

【新唐人2012年12月07日訊】五名裝修民工,因為跟大連瓦房店市市長夫人發生口角,將她的臀部刺傷。當地公安機關做了一份「臨時法醫鑑定」,結論是輕傷,約4個月後,原來的法醫與辦案人員做出法醫鑑定,認定市長夫人「左下肢肌肉萎縮明顯」,「左踝關節功能大部喪失」,屬重傷。媒體人指出,法醫鑑定太兒戲。詳細情況如何,請看以下這則報導:

市長夫人的屁股被幾個裝修工捅了一刀」,這個頗有看點的新聞,12月4號在《民主與法制時報》報導後,立即成了各大知名微博和社交網站的話題。

「市長夫人」指的是遼寧省瓦房店市原市長、現大連市工商局局長蔡有彬的夫人鄒丹。在市長夫婦居住的別墅區,鄰居家進行裝修,噪音、運送裝修材料等影響了他們的安靜。於是,鄒丹多次與幾名裝修工人發生爭吵。 去年8月10號,五名裝修工決定報復。經過策劃,五名裝修工先是劃了她的「奧迪Q7」轎車,繼而用水果刀在鄒丹的屁股上捅了一刀。

大連金州公安分局刑事科學技術室,對鄒丹的傷情予以檢驗。

法醫出具的「臨時鑑定意見」指稱, 「鄒丹左臀部遺留瘢痕長度達8.5厘米」,根據《人體輕傷鑑定標準(試行)》第二十一條之規定,構成輕傷。

可是,事情經過4個月左右發生轉變。

2011年12月9號,在鄒丹位於大連西崗區另一處住宅內,金州公安分局刑事科學技術室再次對鄒丹進行人體損傷程度鑑定。

鑑定書說,「目前左下肢肌肉萎縮明顯,左踝關節功能大部喪失,損傷程度依照《人體重傷鑑定標準》第八條第(二十)款之規定,構成重傷。」

今年8月中旬,大連市金州區法院一審判決,以故意傷害罪和故意毀壞財物罪,分別判處5名被告:三年三個月至三年六個月不等的有期徒刑。被告人不服判決,認為法醫鑑定不真實,一審判決後,為獲取證據,被告人家屬經過長達一個月的跟蹤,終於偷拍到鄒丹邁著輕快的步伐行走在鬧市區的證據,並將畫面提交給二審法庭。

刑辯律師王誓華是其中一名被告的第二辯護人,他認為:此案應屬於一般的民事糾紛,幾個被告人充其量只應受到治安處罰。他說,鄒丹能開汽車,能自如上下臺階,能外出買菜,這符合鑑定報告中所說的「左下肢肌肉萎縮明顯,左踝關節功能大部分喪失」的重傷情形嗎?

如今,二審開庭已過去一個多月。大連中院保持了審慎的態度,對媒體不發表任何看法。

而《法治週末》執行總編輯郭國松認為,因為發生口角而捅刀子,這當然是不法行為,行兇者應當為自己的行為承擔法律責任。但是,法律強調程序正義,斷不能因為這是市長夫人的屁股,就應當罪加一等。

同時,媒體注意到,鄒丹丈夫蔡有彬是一個「裸官」。經調查,鄒丹母子早在2005年就已經移民加拿大,而蔡有彬,2006年從瓦房店市常務副市長位子上升任市長。此後,鄒丹一直在丈夫的權力地盤上經商。2010年,鄒丹以副局級官員的級別,從瓦房店市政府部門辦理了退休手續。

在中央當局三令五申不得提拔重用「裸官」的情況下,蔡有彬這樣的「裸官」卻不斷被提拔和重用,不久前又被任命為大連市工商局局長。

郭國松評論說,一個小小的治安案件,我們卻從中發現了權力的肆無忌憚,法律成了當權者打擊老百姓的工具。沒有對法律的敬畏,官員手中的權力,必然變成脫韁野馬,無法無天。

The Law – ‘A Tool to Combat Ordinary People’

During argument, migrant workers stabbed
Dalian Wafangdian City mayor’s wife in the hip, in August.
The local public security bureau did a ‘temporary forensic
assessment,’ concluding that she has minor injuries.
After four months, the original forensic investigators
made a correction to that conclusion.
They said, the mayor’s wife has severe injuries, including
‘a significant muscle atrophy to the lower left limb,’ and ‘a loss of function of the left ankle joint.’
Media pointed out that the forensic assessment
is like a child’s play. Let’s have a look at the report.

The news, ‘Mayor’s wife was stabbed in the hip by several
migrant workers’ was reported by the Democracy and Legal Times on December 4th.
This became a hot topic on the microblogs,
and social networks in China.

Cai Youbin, is a former mayor of Wafangdian City, Dalian
province, and director of Dalian Trade and Industry Bureau.
The mayor lives with his wife, Zou Dan,
in a villa area.
Their neighbor’s house improvement work, like decoration,
noise, transport of materials, etc., was disturbing them.
Zou quarreled with the migrant workers there several times.
On August 10th, these workers decided to revenge.
After some planning, they first drew on her Audi Q7 car,
and then stabbed her in the hip with a fruit knife.

Dalian Jinzhou Public Security Bureau’ department of
Criminal Science examined Zou’s injuries.

The Forensics’ issued a ‘temporary forensic assessment,’
saying, ‘Zou Dan has up to 8.5 cm long scar on her left hip.’
According to Article 21 of ‘Human minor injuries criteria
(for trial implementation),’ this is a minor injury.

However, things changed after around 4 months.

On December 9th, Zou’s injury was assessed again by
Jinzhou Public Security Bureau’ dept. of Criminal Science.

The assessment says, ‘At present, the left lower limb muscle
atrophies significantly, the left ankle joint lost functions.
According to Article 8, paragraph (20) from Human injuries
accreditation standards, the injuries are classified as serious.’

In August, Dalian Jinzhou District Court sentenced the five
defendants to up to three and a half years imprisonment.
Defendants appealed, arguing against the forensic statement,
and providing photographic evidences of Zou walking freely, with no signs of injury.

Wang Shihua, who is one of the defendant’s counsels,
believes this case should be a general civil dispute,
and the defendants at the most should only be punished
by the general public security punishment.
He said, Zou can drive a car, can freely go
up and down the stairs, and can go out to buy food.
How is this consistent with the injuries,
stated in the assessment report, Wang asks.

At present, more than one month has passed
since the second trial.
Dalian Intermediate People’s Court exhibits cautious attitude,
and does not express any opinion on this issue to the media.

Guo Guosong, managing editor of ‘Law Weekend’ believes,
to stab somebody because of arguments is of course illegal, the perpetrators should be held liable for their actions.
However, the legal emphases must be on procedural justice,
and not favor the sin just because this is an ex-mayor’ wife.

Meanwhile, the media pointed out,
that Zou’s husband, Cai Youbin is a ‘naked official.’
Investigation showed, Zou and her son have immigrated
to Canada in 2005, and Cai became mayor in 2006.
Since then, Zou was doing business under the protection
of her husband’s authority.
In 2010, Zou retired from Wangfangdian
government as a deputy level official.

The central government authorities have being reiterating,
that ‘naked officials’ shall not be promoted.
Yet, as a ‘naked official’ Cai Youbin was promoted, and
even appointed as head of Dalian Trade and Industry Bureau.

Guo Guosong commented that from such a small case,
one can see how the power is unbridled, and the law has become a tool to combat the ordinary people.
Without the fear of the law, the power in the officials’ hands,
will for sure develop into lawlessness.
