【禁聞】習李能否改善中國人權?

【新唐人2012年12月11日訊】12月10號是「世界人權日」,「國際大赦」組織呼籲人們給被囚禁的人權鬥士寫信,其中包括被中共囚禁的人權律師高智晟。中國人權狀況在過去幾年裏越來越受到批評,習、李上臺後能否有所改善?關鍵又在哪裏?請看分析。

「國際大赦」組織在網站上呼籲「這個聖誕爲人權齊心呼籲」(Send a message of solidarity for human rights this Christmas),邀請人們給那些人權受到侵犯的人士寫信、寄卡片或者在Facebook上發送消息,從由於唱歌反對俄羅斯總統普京,而被判刑的女子龐克樂隊「暴動小貓」成員,到被中共囚禁的人權律師高智晟。

高智晟律師因為多次替弱勢群體打官司,曾獲選為「中國十大優秀律師」。他代理法輪功人士的訴訟案件,多次上書中共高層,要求改變對法輪功等群體的非法處理手段。2007年,高智晟被北京第一中級法院以「煽動顛覆國家政權罪」判處有期徒刑三年,緩刑五年,但是長期處於失蹤狀態。 2011年12月,緩刑即將滿期時,法院撤銷他的緩刑,高智晟律師再次被判服實際刑期3年。很多消息指出,高智晟律師在被監禁的過程中受到了非人道的虐待。

時事評論員劉國華:「中國人權狀況在胡錦濤時代可以說是沒有絲毫的改變。我認為這個政治現實和江澤民對法輪功的鎮壓是有直接關係的。胡錦濤執政的這十年中,江澤民實際上還是在控制著中國的政治權力。」

中共將負責迫害法輪功的「610辦公室」併入「政法委」,江澤民還在十六大上,將當時的政法委書記羅幹塞進政治局常委。在長達十三年對法輪功的迫害中,政法委受到縱容,擁有凌駕於法律之上的特權,這套迫害手段逐漸被移用到社會「維穩」上,嚴重破壞了中國司法的獨立和公正。在「十八大」下臺的前政法委書記周永康,權力達到巔峰時,每年掌控高達1100億美元的維穩經費,超過國防預算,將中國百姓視為敵人來鎮壓。中國人權狀況不斷惡化。

「十八大」後,胡錦濤「裸退」與江澤民「同歸於盡」,政法委書記也被踢出政治局常委。習近平上臺後出現了否定江澤民政策的跡象,例如政治局開會通過了八條規定,其中的「規範出訪活動」,捅破了江澤民的「出巡」潛規則。另外,習近平在觀看《復興之路》展覽時,跳過了江澤民和胡錦濤的展廳,並且發言說「空談誤國」。

北京首席辯護律師韓志廣:「隨著中國法治進程的不斷加速,和人們法治理念的不斷加強。中國的人權意識會越來越強了。對高智晟先生會依法作出公正,公平,合理的處理的。」

值得注意的是,有中共政法委背景,近期一直高調在香港攻擊法輪功真相點的「香港青年關愛協會」,突然在習近平7號抵達深圳後收斂,有評論認爲,這是因爲習近平沒有接見捲入江派陣營的現任港首梁振英。

時事評論員劉國華:「中共十八大以後,香港搞了這麽些動作,目地就是要捆綁習近平,繼續把鎮壓法輪功的這套行不通的政策繼續給推下去。習近平拒絕接見現在的香港特首,證明了習近平對江澤民對法輪功的鎮壓,他是不贊成。」

有學者表示,民眾對於目前習近平提出的八條,和尊重憲法的言論,持謹慎期待的態度,因爲類似的話10年前也有人說過。

而北京維權人士胡佳認為,過去一年是中共政權侵犯人權的高峰年。他對英國廣播公司BBC說:「現在中共權貴尊重人權與否﹖已經不重要了,普通公民應該站出來維護自己的權利。他說,中共加緊控制,與民眾的維權努力,將會不斷進行較量,這樣的拉鋸戰會在未來一年頻頻上演。」

Can Xi-Li Improve Human Rights in China?

December 10 is Human Rights Day. Amnesty International

organisations urged people to write to the imprisoned human rights activist,

including the human rights lawyer Gao Zhisheng imprisoned

by the Chinese Communist Party (CCP).

The human rights situation in China has often been criticised

in the past few years.

Xi-Li has come to power now, but can they improve on it?

Where are the key points? Please read the analysis.

“Amnesty International" organisation has called for 『Christmas

concerted appeal for human rights』 on the website,

inviting people to write about human rights violations,

sending cards or messages on Face book to victims of human rights violations.

These range from the band member of the “Pussy Riot” to

human rights lawyer Gao Zhisheng.

Gao Zhisheng was once selected as “China’s top ten outstanding

lawyers” for his representing vulnerable groups many times.

He took on Falun Gong practitioners』 cases and repeatedly wrote

open letters to the top level of the CCP.

He asked the regime to change its illegal means whilst dealing

with Falun Gong and other groups.

In 2007, Gao Zhisheng was sentenced to three years imprisonment

and five years probation by the Beijing First Intermediate

People’s Court, for supposedly “inciting subversion of state power."

However, he has been missing for a long time now.

In December 2011, when his probation was about to expire,

the court revoked his probation.

Gao Zhisheng was yet again sentenced to serve

the actual term of 3 years.

Many sources pointed out that lawyer Gao Zhisheng

was abused while under custody.

Political commentator Liu Guohua: “During the Hu Jintao era,

there was no change in the human rights situation.

I believe that there is a direct relationship between this political

reality and Jiang Zemin’s crackdown on Falun Gong.

In Hu’s ruling decade, Jiang Zemin was actually in control

of political power in China.”

The Chinese regime will be responsible for incorporating

the “610 Office" into the Politics and Law Committee where Jiang Zemin placed Luo Gan in charge.

During the 13 year persecution of Falun Gong, the secretary of

Politics and Law has acquired privileges above the law.

The persecution was gradually turned into a “social

stability maintenance”,

seriously undermining the independence and impartiality

of the judicial branch.

Shortly before 18th Congress, Zhou Yongkang,

secretary of Politics and Law Committee,

had reached the pinnacle of his power controlling up to

$110 billion of funding for maintenance of stability.

In actuality, it was more than the defence budget alone,

but worse still was used in the suppression of innocent Chinese citizens, dubbed the enemy.

China』s human rights are rapidly deteriorating.

After the 18th Congress, Hu Jintao stepped down with no strings

attached with the intention of eliminating Jiang Zemin』s power.

The secretary of Politics and Law Committee has also been

kicked out of the Politburo Standing Committee.

Xi Jinping, after taking office, also denies Jiang Zemin’s policies.

For example, passing such rules as the “specifications of

visiting activities” and exposing the unspoken rules of Jiang Zemin’s" Parade".

When viewing “Road to Revival" exhibition,

Xi Jinping skipped the showrooms of Jiang and Hu

and made a speech on, “Empty Words Damage China.”

Han Zhi Guang, chief defense counsel in Beijing:

“Since the process of rule of law in China constantly accelerating,

people continue to strengthen their awareness on

China’s human rights.

Mr. Gao Zhisheng will be treated fairly and reasonably,

according to the law.”

It is worth noting that recently high-profile attacks on

Falun Gong in Hong Kong by “Hong Kong Youth Care Association,

which is tainted with support from the Political and

Law Commission, have become weakened after Xi Jinping arrived in Shenzhen on Dec.7.

Some believe its because Xi Jinping did not meet with

the current chief of Hong Kong, Leung Zhen-ying, who is also pro-Jiang faction.

Current affairs commentator Liu Guohua:

“After the 18th Congress,

the incidents in Hong Kong are to force Xi Jingping to

continue the persecution of Falun Gong.

When Xi refused to meet with Leung Zhenying, he was telling

people that he disagreed on the persecution of Falun Gong.”

Some scholars comment that Xi Jinping』s recent eight rules and

respect for the Constitution had been brought out ten years ago.

Thus, people would look at it with a cautious mind.

Beijing human rights activist Hu Jia believes the

Chinese regime has the worst record of human rights violations in this past year.

He told the British Broadcasting Corporation (BBC), “Whether

the CCP respects human rights or not is no longer important.

Ordinary citizens should stand up and defend their rights.

He said the more the CCP tightened its controls,

the harder the people will defend human rights.

The contest will continue, like a tug of war staged frequently

in the coming year.
