【禁聞】西班牙法院向江澤民等人發逮捕令

【新唐人2013年11月21日訊】西班牙國家法院11月18號,向中共前黨魁江澤民發出逮捕令,指控江澤民涉嫌對中國西藏進行種族滅絕罪,一同被起訴的,還包括中共前國務院總理李鵬等4名中共官員。

11月18號,西班牙法院再次針對前中共領導人江澤民、李鵬,胡錦濤等5名官員,在西藏的「反人類」罪行,發出逮捕命令。馬德里法院已通過中共大使館遞出起訴書。

《西藏之聲》報導,西班牙援藏組織自2005年開始,多次向西班牙法院提出法律訴訟,指控江澤民等7名中共官員在西藏犯下「反人類」罪行。今年10月10號,西班牙最高法院方面受理了此案。

11月19號,《美國之音》從一名原告那裏,獲得了一份一天前簽發的裁定書複印件。這份裁定書是由西班牙馬德里法院簽發,要求「逮捕」江澤民和其他4名官員。

西藏流亡政府國會議員Norbu Tsering:「這是向前的一大步,我認為還會有其他國家也邁出同樣步伐。真相總會勝出,永遠是這樣。」

西藏人民議會歐洲地區議員圖丹旺青,在接受《西藏之聲》的電話採訪時說,西藏的局勢變得越來越緊張,他們多年來針對中共在西藏的罪行提出了訴訟,這次取得了成果,算是把西藏的真相告知於世。

在此之前,中共辯稱,西班牙的調查內容虛構,並干涉了中國內政。但西班牙最高司法機構——憲法法院認為,「反人類」罪行影響的不僅是受害者本人,而是整個人類,因此允許對在西班牙領土外犯有「群體滅絕罪」的嫌疑人,使用「普適管轄權」,而予以審判。

時事評論員橫河:「把這些案子曝光在國際社會上,大家去看,你究竟這個人權狀況好得甚麼程度﹖惡劣到甚麼程度﹖通過這些案子的進展,其實你可以從西班牙法庭對跟中共有關的,普遍管轄原則所進行的案例來看,實際上西班牙的法庭已經毫無疑問的認定了,這個案子是屬於反人類罪的,屬於群體滅絕罪的。」

美國紐約城市大學政治學教授夏明:「我們看到,現在對危害人類的這種罪行起訴,也不斷的出現,像我們看到就是南斯拉夫了,包括就是我們看到在紅色高棉的前領導人,進行審理等等。人類對人權保護,尤其是用司法武器,去執行和貫徹人類制定的人權法,這個我覺得是一個根本的發展。」

事實上,江澤民等人已經在多個國家被起訴,在西班牙也並非首次。自2003年開始,前後持續5~6年,針對中共官員江澤民、羅幹、賈慶林、薄熙來、吳官正等5人的訴狀,已陸續送達西班牙法庭,他們被控對中國的法輪功學員犯下「群體滅絕罪」和「酷刑罪」。

西藏流亡政府國會議員Norbu Tse ring表示,中國的人權時至今日,完全沒有改善。

Norbu Tse ring:「滑稽的是,它得到了席位,聯合國在人權委員會上,展示那麼多論證。這真是一場災難,聯合國明白中國發生著甚麼,儘管這樣,還讓中共佔據了席位。」

據了解,自2009年2月起,有關藏人自焚的事件時有發生。2009年以來的自焚藏人有126人(其中境內藏地121人,境外5人)。其中至少103人死亡。

美國紐約城市大學政治學教授夏明:「到今天,對西藏的鎮壓沒有減輕,相反在不斷的加大。面對西藏120多人自焚的情況下,中共還沒有採取任何的改進措施,在這種情況下,應該說對西藏問題的關注,反映出全球社會對總體中國的人權狀況的失望。」

圖丹旺青認為,各界對西藏問題的了解不斷增加,特別是不斷有藏人不滿中共統治而自焚犧牲,這些都是活生生的證據,因此他呼籲藏人們鼓起勇氣付出行動。

Spanish Court Issues Arrest Warrant for Former CCP Leaders

The Spanish National Court issued an international arrest

warrant for the former Chinese Communist Party (CCP) leader

Jiang Zemin on 18th November,

indicted for alleged genocide in Tibet.

Also indicted are four other CCP officials,

including former PM Li Peng.

On the 18th November, Spain’s court once again issued arrest

warrants against five CCP officials, including former leaders

Jiang Zemin, Li Peng, and Hu Jintao on charges of

“crimes against humanity".

The Madrid based National Court has handed out the

indictment through the Chinese Consulate.

Voice of Tibet (VOT) reported that since 2005

the Tibet support committee in Spain has filed several legal

proceedings to the Spanish court, accusing Jiang Zemin and

six other Chinese officials of alleged “crimes against

humanity" in Tibet.

On 10th October, the Spanish National Court

accepted the case.

According to Voice of America, VOA obtained a copy of the

ruling of the Madrid-based court from one of the plaintiffs

on Nov. 19, “the document, issued a day earlier, called for

the arrest of former Chinese President Jiang and the other

officials to enable authorities to question them

about the genocide allegations."

Norbu Tsering, MP of Tibetan Parliament-in-exile:

“It is really a great step forward.

I think there will be some other country that

will follow the same step.

Maybe this is just the beginning."

The truth will always prevail, and definitely forever.

Parliament Members of Tibet from Europe, the Venerable

Thubten Wangchen, told VOT in a telephone interview that

the situation in Tibet has become increasingly strained.

They have filed lawsuits against the CCP’s crimes

in Tibet for many years.

This success is a step further to tell the truth

about Tibet to the world.

Prior to this, the CCP argued that the charge was a false

accusation and an attempt to “interfere"

in Beijing’s “internal affairs."

However, the Spain court believes that crimes against humanity

affect the entire human race and the universal jurisdiction

allows its courts to prosecute alleged

genocide committed anywhere.

Hen He, commentator: This lawsuit exposes to the world

that human rights issues in China have turned for the worst.

The Spain court has unquestionably recognized this case is a

crime against humanity, genocide according to the court’s

acceptance of this case following the

universal jurisdiction procedure.

Xia Ming, professor of Political Science, the City University of

New York: “We now see the emerge of the prosecuting of crimes

against humanity from Yugoslavia to the former leader of

the Khmer Rouge.

I believe this is a fundamental development, a protection and

implementation of human rights through the judicial system."

In fact, lawsuits against former CCP leader Jiang Zemin

and other officials have been filed

in many other countries as well.

It is not the first time for the Spain court either.

Since 2003, multiple lawsuits against CCP officials such as

Jiang Zemin, Luo Gan, Jia Qinglin, Bo Xilai, and

Wu Guanzheng have been submitted to the Spain courts for

genocide and crimes of torture against

Falun Gong practitioners in China.

Norbu Tsering, MP of Tibetan Parliament-in-exile, indicates

that human rights in China have not improved at all.

Norbu Tsering: “The funny thing is that last

week the UN had already issued them a

seat in the Human Rights Committee.

It is an absolute disaster.

The UN understands what is happening in China.

Despite that, they allot a seat to China."

Since Feb. 2009, the Tibetan self-immolation incidents have

occurred from time to time.

So far, there have been 126 Tibetans committing

self-immolation (including 121 people inside Tibet,

five from outside of Tibet).

At least 103 people have died.

Xia Ming, professor of Political Science, the City University of

New York: Till this day, the repression in Tibet

is constantly increasing.

Facing more than 120 cases of self-immolation,

the CCP has not taken any measures for improvement.

In this case, the Tibetan issues reflect the world view of the

overall disappointing human rights situation in China.

The Ven. Thubten Wangchen indicated that it is evident that

the world was made aware of the Tibet issue, especially with

so many Tibetan self-immolation incidents.

He encouraged the Tibetans to continue their

efforts (with the lawsuit) to solve the Tibetan issues.
