【禁闻】李克强称食品安全违法 成本太低

【新唐人2014年05月17日讯】日前,中共国务院总理李克强在主持常务会议时,提到了“三聚氰胺”,他表示,毒奶粉事件之所以发生,在于食品安全的违法成本太低,应该通过修法,给予违法犯罪份子最严厉的处罚。不过,民众对中共当局的做法,并不乐观。

5月14号,李克强主持召开国务院常务会议,讨论通过《食品安全法(修订草案)》。李克强表示,2008年“三聚氰胺事件”发生后,政府出动大批警力,清剿问题奶粉和违法犯罪份子,但因受限于当时的法律、法规,很多违法犯罪份子只付出了很低的成本

李克强强调,“要通过修法,给予他们最严厉的处罚!”

北京律师谢燕益:“这个违法份子,他的定义所指,是很关键的,只要这个违法份子的主体指向,比方说政府监管部门的腐败份子,有可能公权力寻租的,当然也包括一些官商勾结的,既包括官方本身,也包括食品生产者,他们之间的利益交易,能够在制度方面进行有效的控制的话,可能有一定的效果。”

大陆结石宝宝母亲蒋亚林:“国家不是没有法律,现在关键是有法不依的问题,反正我是不相信,我也不会让我周边的人相信这个奶粉会好,一朝被蛇咬,十年怕井绳。而且各方面让我觉得,他们的公信力在不断的降低,如果我有能力或有条件去选择更安全的食品,我绝对不会用中国的食品。”

大陆“结石宝宝”母亲蒋亚林的女儿,是在2008年9月19号被检查出体内有2到3粒,米粒大小的双肾结石。

据报导,2008年9月8号,甘肃岷县14名婴儿同时患有肾结石病症,引起外界关注。到9月11号,甘肃全省共发现了59例肾结石患儿,部分患儿已发展为肾功能不全,有1人死亡,这些婴儿都食用了“三鹿奶粉”。

“三鹿”婴幼儿奶粉随后被证实受到化工原料“三聚氰胺”的污染。除了“三鹿”外,伊利、蒙牛、光明等22家婴幼儿奶粉生产企业的产品,也相继被检出了“三聚氰胺”。

谢燕益:“往往这些食品、药品的批文,就是由监管部门来负责颁发的,他既进行日常的监管,也负责食品生产的行政许可。也就是说,我们食品的安全情况,主要取决于政府部门的状态,如果是一种腐败的状态,食品领域出现的问题就会很普遍,甚至会带来灾难性的后果。”

“三鹿集团”是中外合资公司,它最大的海外股东是纽西兰“恒天然公司”。据了解,“恒天然”公司在2008年8月得知奶粉出现问题后,立即向中资方和中共地方官员要求召回“三鹿集团”生产的所有奶粉,但都没有结果,只好向纽西兰政府报告。9月5号,纽西兰政府下令官员绕过中共地方政府,直接向中共中央报告。

2008年9月13号,中共国务院启动国家安全事故一级响应机制,处置“三鹿奶粉污染事件”。不过,中共中宣部9月14号下令,禁止大陆媒体擅自报导“三鹿事件”,一律要以官方公布或官媒《新华社》报导为准。

谢燕益:“我觉得主要是政府方面的责任,要加大政府方面的责任,包括渎职、他们的不作为,或者滥作为的这种违法成本,惩处的后果相当严厉的话,可能会起到一定的作用,但是我觉得很难治本的。”

2008年9月,北京市民赵连海的儿子也被发现有肾结石。赵连海曾在媒体工作多年。随后他成立“结石宝宝之家”,联合受害人家庭集体维权。2010年11月,他被当局以“寻衅滋事罪”,判处2年半有期徒刑。

大陆网友陈先生:“要真正的纠正这个,必须政治体制改革,多党轮流执政,把选票给群众,让群众投票,选出来的官员才可能杜绝这样的问题。”

蒋亚林:“如果我能够移民,我绝对移民,也不会在这里,我吸的空气是有毒的,土壤是有毒的,自来水是有毒的,里面有60多种抗生素,吃、穿、住、行没一样安全的。”

蒋亚林指出,自中共统治以来,中国社会道德普遍下滑,自然资源也被破坏殆尽,而这些是几百年后代子孙都难以回复的。

Li Keqiang: Food Safety Law Violations Carry Low Penalties

Recently, Chinese Premier Li Keqiang mentioned the
melamine incident in the executive meeting.
He said, the reason for the tainted milk incident is the small
punishments over violation of food safety laws.
We should amend the law to give criminals
the most severe punishment.
However, citizens are not optimistic on the Chinese
Communist Party (CCP) putting this into practice.

On May 14, Li Keqiang chaired a State Council executive
meeting to discuss Food Safety Law (Revised Draft).
Li Keqiang said that the criminals of 2008 melamine incident
paid very little due to the limited laws and regulations even
though the CCP dispatched a large number of police to clean
up the milk powder and criminals.

Li Keqiang stressed: “They must be given most severe
punishments by amending the law!"

Beijing lawyer Xie Yanyi:"The definition of who the
criminal is are is critical.
If by criminals they mean the corrupt government regulators
including public officials seeking rents, corrupt collusion
between business and officials including self interest between
officials and the milk producer, it may have an effect."

Mainland mother Jiang Yalin: “The State has laws,
which are not obeyed.
I won’t trust them or let people around me trust the milk
powder because a burnt child dreads the fire.
I think their credibility is declining continuously from all
aspects. I will never use Chinese food if I can."

Jiang Yalin’s daughter was diagnosed with kidney stones in
both kidneys on September 19, 2008.

According to reports on September 8 2008, in Gansu Minxian
14 babies also had kidney stones causing outside attention.
By September 11, 59 children had kidney stones in Gansu
province; some had renal insufficiency and one died.
These babies all were fed Sanlu milk powder.

Sanlu infant formula was subsequently confirmed to be
contaminated by the chemical melamine.
As well as Sanlu, Yili, Mengniu, Guangming and 22 other
manufacturers of infant formula also contained melamine.

Xie Yanyi: “The approval of these foods, and medicines are
issued by the regulatory authorities in charge of routine
supervision and administrative licenses of food production.
It means our food safety mainly depends on the government;
a corrupt government may result in very common problems
in food safety, or even catastrophic consequences."

Sanlu Group is a joint venture company whose largest foreign
shareholder is New Zealand Fonterra.
It is said that Fonterra requested a recall of all milk powder
from Sanlu group when they learnt of the problem in August
2008, but in vain.

They had to report to the New Zealand Government. On
September 5, 2008, the New Zealand government ordered
local government officials to report directly to the CCP and
bypass the local government.

On September 13, 2008, the State Council started first level
national security accident response mechanisms to deal with
the Sanlu milk powder incident.

However, on September 14 the CCP Central Propaganda
Department prohibited mainland media from reporting the
Sanlu incident and only rely on the official announcement
or official media Xinhua News Agency report.

Xie Yanyi: “I think it is primarily government responsibility.
They should increase the CCP responsibility including the
price of dereliction, illegal actions, no action or abuse of law.
If the punishment cost is harsh, it might work,
but will be hard to cure."

In September 2008, Beijing resident Zhao Lianhai’s son had
kidney stones. Zhao worked for the media for many years.
So he set up the Lithiasis Babies Family to jointly petition
with other victims’ families.
In November 2010, he was sentenced to two and a half years
in prison by the CCP on charges of disturbing public order.

Mainland netizens Mr. Chen: “Political reform is necessary
to correct it.
The multi-party system lets the people vote to pick
officials and end such problem."

Jiang Yalin: “If I can immigrate, I absolutely will do it.
The air here is toxic, the soil and water is toxic, including 60
kinds of antibiotics. Eat, live, cloths and walking are not safe."

Jiang Yalin pointed out that since the CCP has been in power,
China’s moral fell and natural resources have been destroyed.
All of which are hard to get back.
