【禁闻】酷刑受害者:中共酷吏违反国际公约

【新唐人2012年6月28日讯】酷刑为《国际法》规定的一种罪行,《禁止酷刑公约》在1987年6月26号生效,因此联合国大会将6月26号定为“支持酷刑受害者国际日”,联合国在这一天提出呼吁,要求各国政府确保酷刑受害者的申诉权。虽然,中国在86年签署了《禁止酷刑公约》,并在88年获得批准,但是酷刑在中国仍然普遍发生,情况极为严重,大陆媒体却不予报导,中国酷刑受害者因此呼吁,受迫害者勇敢站出来揭露施暴者的罪行,实际点名中共酷吏违反国际公约。

联合国在6月26号“支持酷刑受害者国际日”发表声明指出,“酷刑”为《国际法》规定的一种罪行。根据所有有关文书,酷刑受到绝对禁止,并且在任何情况下不得为其辩护。这也意味着,它对国际社会的每一个成员都具有约束力,经常的或广泛的施加酷刑的作法构成“危害人类罪”。

位于印度达兰萨拉的藏人行政中央和西藏前政治犯组织, 26号联合举行“支持酷刑受害者国际日”纪念活动,通过图片展、演讲、话剧表演等向民众介绍境内藏人,特别是政治犯在中共当局的高压政策下,所遭受的酷刑折磨。

大陆维权律师刘晓原在博客中说,由于中国的媒体不作报导,很少有民众知晓这个国际日。

而北京维权人士胡佳也向《新唐人》表示,中共当局不会去宣传“支持酷刑受害者国际日”这样的日子,因为在中国施加酷刑者恰恰是中共的党政酷吏,尤其是政法系统官员。

据报导,毕业于“北京大学”拥有法学硕士学位的曹顺利,经常为全国各地访民提供法律协助,当局因此借机打压她。2009年4月10号当局以“毁坏财物罪”判处曹顺利劳教一年。2010年4月11号刑满获释18天后,曹顺利前往安外派出所办理身份证时,被派出所以毁坏会议室玻璃拘留十天,之后分局再次给曹顺利判处一年零三个月的劳教决定。

北京法律维权人士曹顺利:“这23个月我觉得酷刑挺普遍的,这是第一个,第二个就是承受酷刑的人都是一些默默无闻的人,他们没有机会和能力,揭露自己的经历。我认识的上访的,几乎都被关过小号。两年前的今天,我刚才想了想,我正在劳教所承受酷刑呢!因为我不遵守他们的制度,他们5天没给我饭吃,最后又给我鼻饲了3天。”

胡佳呼吁遭受酷刑的受害者,如访民,或维权人士及维权律师,不要吝啬把他们的经历谈出来,实际点名中共酷吏违反国际公约。而他也认识对法轮功学员实施各种酷刑的人员。

北京维权人士胡佳:“这种见证人跟我说过,这种剥夺睡眠的时间和殴打啊,的的确确存在,而且已经相当长的时间了。就是我在被判刑往监狱的过程中,囚车上一共三个人,都是政治犯,其中有一个70岁的老人叫翟广才,他就是法轮功的,他(被判)三年有期徒刑,被押解往前进监狱,北京市监狱管理局清河分局的前进监狱,有专门的法轮功监区。”

胡佳认为,没有任何制约的专制体制,酷刑容易被滥用。而北京律师牟继源也对中共体制下的司法公正,表示无奈!

北京律师牟继源:“法律也只能是一种工具,维护主事者利益的工具,只能为他的利益服务,它不是为了维权。”

牟继源律师认为,现今的中国社会问题,不是哪个领导人可以面对和解决的,必须动“大手术”才能根治,否则任何人上来都只能“无可奈何”。

Chinese Regime Violates UN Convention Against Torture

Torture is a crime under International Law.

The UN Convention Against Torture (UNCAT)
took effect on 26th June, 1987.
The UN marked June 26 as International Day in
Support of Victims of Torture.
On the same day, the UN urged all government
to ensure victims’ rights of appeal.
China signed the UNCAT in 1986,
and was ratified in 1988.
However, torture is commonplace in China,
and is extremely severe.
Mainland media has never reported on this issue,
thus, victims urge to expose the torture.
They directly pointed out,
Chinese regime violates the UNCAT.

On 26th June, the International Day in Support of Victims
of Torture, the UN stated that torture is a crime under UNCAT.
According to all relevant instruments, torture is absolutely
prohibited, and can’t be justified under any circumstance.
Thus, it is binding on every member of the
international community.
Frequently or widely using torture commits
“crimes against humanity”.

Central Tibetan in Dharamsala, India and former Tibetan
political prisoner group held commemorative events on 26th.
They displayed photos, gave speeches and performances to
introduce Tibetan’s life in China.
They particularly demonstrated tortures that
political prisoners encountered.

Liu Xiaoyuan, human rights lawyer in China said in his blog:

due to media in China haven’t reported on this issue,
Chinese barely are aware of the International Day in Support of Victims of Torture.

Beijing Activist Hu Jia told NTD that the Chinese regime
would never promote this kind of day.
One who practice torture in China are Chinese Communist
Party’s (CCP) merciless officials.
Particularly the Political and Legislative Affairs
Committee officials.

Sources said that Cao Shunli, activist lawyer often helps
petitioners over China, thus, the CCP persecuted him.
On April 10, 2009, he was jailed for one year for the
“crime of damaging public property”.
On April 11, 2010, after 18 days of release, he was detained
for 10 days when he registered an identification in police station.
Later he was sentenced for 15 months in jail.

Cao Shunli: “23 months in jail made me feel torture
is commonplace, this is the first point.
Secondly the victims of torture are vulnerable people,
they have no chance and power to expose their suffering.
I knew some petitioners, almost all experienced
being locked up in a small cell.
On the same day two years ago, I was being tortured.
As I didn’t follow their rules, I forbade eating for 5 days.
They forced fed me through my nose for three days.”

Hu Jia urged victims of torture, such as petitioners, activists
and human rights lawyer to speak out their experiences.
Directly point out the CCP was against UNCAT.

Hu also remembers those who tortured
Falun Gong practitioners.

Hu Jia, “The witnesses told me, prohibition of sleep
and beating exist for a long time.
Once when I was on the way being taken to jail, there were
three people in a police van, we are all political prisoners.
An old man called Cui Guangcai, was over 70,
he was Falun Gong practitioner and was jailed for 3 years.
They were sending him to Qianjin jail in Beijing,
a district specially for holding Falun Gong practitioners.”

Hu Jia believes that a regime without any constraints,
torture is easily used.
Beijing lawyer Mu Jiyuan expressed having no choice
under the CCP system.

Mu Jiyuan, “Law is only a tool to maintain ruler’s interests.
It severs for ruler but not maintaining human rights.”

Mu Jiyuan believes that China’s social problems could
not be solved by any of a single leader.
It needs to remove the root (Communism) itself, otherwise,
It would be a mission impossible.
