【新唐人2014年07月29日訊】日前，中國九個省份的17名律師，要求司法部撤銷違法的「律師年度考核」，和行政備案，有律師表示，這些是前中共政法委書記周永康在位時制定的反法制，反民主的「黑政策」，而目前司法部仍然保留這一遺毒，律師呼籲，如果要建立一個真正的法制社會，必須剷除這一「黑堡壘」。
7月28號，北京維權律師程海發博文說，全中國九個省的17位律師，複議司法部要求撤銷違法的律師年度考核和行政備案，7月22號，申請書已郵寄送達司法部，但直到目前仍沒有得到回應。他表示，如司法部不給予支持，將訴訟或申請國務院裁決。
大陸維權律師冉彤、程海、王全璋、王宇、蔡瑛等17人，在送達司法部的行政複議申請書上請求：撤銷律師執業證上印製的律師年度考核備案頁，或確認違法。
還要求撤銷律師執業證尾頁印製的「並應當加蓋律師年度考核備案專用章」字樣，或確認違法等。
四川律師冉彤表示，今年以來，他們一批律師，先後向司法部遞交了信息公開申請複議書，要求司法部取消沒有法律依據的，對律師們構成嚴重行政侵權的違法年檢和備案。
而所有試圖用法律主持公義的維權律師，今年以來，都成了當局嚴厲打擊的對像，今年的律師年檢中，很多律師因辦理一些當局認為敏感的案件沒有通過年度考核，其中包括：程海、蔡瑛、謝陽、張傳力、蘭志學、董前勇等律師。
四川律師冉彤：「這本來就是周永康政法委書記想篡黨奪權，制定了一系列的黑政策，對律師的打壓違法反動政策，司法部就是一個積極的貫徹走狗，這完全是反法制，反民主的那一套。」
冉彤表示，現在當局已處理了周永康，並取消了大量的審批管制，如果想建立一個法制社會，必須徹底剷除周永康遺留的這一「黑堡壘」。
北京維權律師程海表示，律師年度考核和備案，是對律師的侮辱和歧視，是當局專門用來打壓那些敢於主持正義，依法辦案律師的違法「黑政策」。
北京維權律師程海：「另外一個，就是它藉機收費，幫助律師協會收費，收很高的費用，一年一個人要2000塊錢，整個律師所收1萬多到1萬5，然後全國的律師協會收費達到7個億。」
中國律師年檢一直被輿論抨擊存在嚴重貪腐。據報導，2011年廣東深圳有424家律師事務所，7398名律師，僅深圳一地，每年收費就高達1928萬元。而這些費用的開支情況從來沒有公開過。
湖南律師蔡瑛表示，這就形成了很多權力的尋租和腐敗，同時也成為有關部門，敢於打壓依法辦案律師的一種手段。
蔡瑛律師因代理「雙規案」、「建三江刑拘四律師案」以及「謝陽律師起訴湖南省司法廳案」等，年檢被卡，還殃及全所，他所在的「湘軍律師所」，直到現在還沒有通過年檢，律所工作和律師業務受到了影響。
湖南律師蔡瑛：「我認為不給我們搞年檢的話，是對我的一種打擊報復，律師事務所不搞年檢的話，是通過律師事務所施加壓力，來使律師事務所的律師們對我個人，形成一些感情方面的壓力和根子方面的壓力，是迫使我離開事務所。」
據了解，目前有律師責怪蔡瑛不該代理一些當局不喜歡的案件，甚至還有律師要求蔡瑛退出律師事務所。
蔡瑛表示，目前他所在的律師事務所很被動，他去「維權」的話，怕律所再次遭到「律協」和司法部打壓，而他不去「維權」，就不能撤銷違法的律師年度考核和行政備案等制度，所以他們都很糾結。

Lawyers: Revoke Annual Assessmen
Seventeen lawyers from nine provinces demand the Ministry
of Justice revoke lawyer’s annual assessment
and all administrative records.
The lawyers indicate the assessment is anti-rule of law
and anti-democracy.
This illegal rule was established by Zhou Yongkang.
While Zhou is sacked, this gang rule still remains.
Lawyers believe that, to build a legal society,
this rule must be abolished.
Cheng Hai, Beijing human rights lawyer stated in his
blog, on July 28, 17 lawyers from nine provinces demand
the Justice Department stop the illegal annual assessment
and abolish all administrative records.
The application arrived in the Justice Department on July 22.
While the Justice Department has yet to respond,
he said, it will be processed to the State Council.
Ran Tong, Cheng Hai, Wang Quanzhang, human rights lawyers,
among the 17, stated in the administrative reconsideration request:
Revoke the annual assessment page on the lawyer’s practicing
certificate, or confirm it as illegal.
It also called for the removal of the prints, “Should stamp
annual assessment seal" from the final page of the lawyer’s
practicing license, or render it as illegal.
Sichuan lawyer, Ran Tong, indicates that they have filed
numerous written requests to the Justice Department to cancel
the lawyer’s annual assessment and the administrative record,
for the policy has no legal basis and constitutes serious
infringement of lawyers rights.
Many rights upholding lawyers have become victims
of the suppression.
Many, including Cheng Hai, Cai Ying Xie Yang and others,
have failed to pass the assessment for handling
the so-called cases sensitive to the authorities.
Ran Tong: “It was part of the gang policies Zhou Yongkang
had manipulated to usurp power.
He set up this policy, during his tenure as Secretary of the
Central Political and Legislative Committee, to suppress
the lawyers.
The judiciary is carrying out this policy like his aggressive
lackeys.
This policy is totally anti-legal and anti-democracy."
Ran Tong indicates that Zhou Yongkang has been sacked,
and many of his regulations removed.
In order to build a law-based society,
this last gang policy must be eradicated."
Beijing human rights lawyer, Cheng Hai, explains the annual
assessment is a humiliation to the lawyers and discriminating
against them.
It is a gang policy specifically targeting lawyers
who dare to uphold justice."
Cheng Hai: “Its other purpose is to make money.
The fee is very high.
The Lawyers Association charges 2,000 yuan a person each
year, and somewhere between 10,000 to 15,000 yuan to the firm.
Nation wide, the Lawyers Association will receive
700 million yuan each year."
Chinese lawyers’ annual assessment has been criticized
as engaging in serious corruption.
According to reports, Shenzhen received 19.28 million yuan
in 2011 from 424 law firms and 7,398 lawyers.
But, none of the expenditure was ever disclosed.
Hunan lawyer, Cai Ying, says the assessment allows the
authorities to display their power and conduct corrupt deeds.
Governmental agencies also get to suppress the lawyers
by manipulating the assessment.
Cai Ying’s annual assessment was put on hold for his sensitive
cases such as the rights defending case in Liaoning,
the illegal detention of four attorneys case in Jiansanjiang,
and attorney Xie Yang’s lawsuit against Hunan provincial
Department of Justice.
The firm he works for was also implicated.
Lawyers in the law firm could not proceed with their cases
without the annual assessment.
Cai Ying: “I think it is a retaliation against me, and a pressure
on the law firm.
The law firm and the lawyers in the firm will in turn
put pressure on me and force me to leave the firm."
There are lawyers blaming Cai Ying for accepting cases
sensitive to the authorities, while others demand Cai Ying
leave the firm.
Cai Ying indicates the firm is being passive.
If he defends for the lawyer’s rights, the firm might be subject
to another year of suppression by the Lawyers’ Association
and the Justice Department;
If he does not defend for the lawyer’s rights, the illegal
assessment and administrative records could continue.
It has become a dilemma for everyone.
